Terms & Conditions

In these Terms and Conditions, "Agreement" means the entire contractual relationship between you and the Operator governing your access to and use of MakZens, comprising these Terms and Conditions, the Privacy Policy, any premium plan terms, and any supplemental policies or notices published by the Operator from time to time. Each of these documents is incorporated by reference and forms an integral and binding part of the Agreement. In the event of any conflict between these Terms and Conditions and a supplemental policy addressing a specific subject matter, the supplemental policy shall prevail to the extent of that specific subject matter.

"MakZens", the "Service", or the "App" means the real-time, cross-language messaging application and all associated software, features, application programming interfaces, content, and functionality made available by the Operator, whether accessed through the Android application package, the installable progressive web application, or the browser-based web client. The Service includes, without limitation, one-to-one chats, group chats, public and private channels, voice messages, voice and video calls, photo and file sharing, location sharing, message reactions, replies, editing, disappearing messages, contacts matching, push notifications, message deep links, and multi-device access. References to the Service extend to any updated, modified, or successor version thereof.

"Operator", "we", "us", or "our" means JXMSN LLC, a company having its registered address at PO Box 393394, Dubai, United Arab Emirates, together with its permitted successors and assigns. The Operator is the entity that provides, controls, and is responsible for MakZens and acts as the data controller in respect of personal data processed through the Service, save where these Terms expressly provide otherwise. Any reference to the Operator includes its officers, employees, and duly authorised representatives acting within the scope of their authority.

"User", "you", or "your" means any natural or legal person who accesses, installs, registers for, or otherwise uses the Service, whether or not that person has created an account. Where you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to this Agreement, and "you" shall be construed to include both you and that organisation. The obligations of Users under this Agreement are joint and several where more than one person uses a single account.

"Translation Processor" means any third-party artificial intelligence or large language model provider engaged by the Operator to perform automated, real-time translation of message content and related linguistic functions. You acknowledge that the core cross-language feature of the Service depends upon such third-party processors, and that the accuracy, tone, and fidelity of any translation are inherently probabilistic and not guaranteed by the Operator. The identity of the engaged Translation Processors may change over time as further described in the Privacy Policy.

"Message Content" means any text, and its automatically generated translation, together with voice messages, images, files, location data, reactions, and other material that you transmit, receive, or store through the Service. You acknowledge that, to deliver the translation feature, the original text of a message is transmitted to one or more Translation Processors, which return a translated version, and that both the original and the translated text are handled by the Service for the purpose of delivering the message to its recipient. Message Content does not cease to be your responsibility by reason of having been translated.

"Payment Processor" means NowPayments, the independent third-party service that facilitates settlement of amounts due for Premium Services, and "USDC" means the USD Coin stablecoin as accepted for payment on the Solana or BSC networks. You acknowledge that all payment transactions are processed by the Payment Processor under its own terms, that the Operator does not custody, hold, transmit, exchange, or invest any cryptocurrency on your behalf, and that the Operator provides no wallet, exchange, brokerage, investment, or financial-advisory service of any kind. The Operator's role is limited to recognising confirmed payment events reported by the Payment Processor.

"Premium Services" means those optional paid features, capabilities, or entitlements offered by the Operator, whether by way of one-time purchase or recurring subscription, that are unlocked upon successful payment or upon a valid alternative unlock as defined below. Premium Services are supplied in addition to the free features of the Service and are subject to the pricing, billing cycle, and renewal terms disclosed at the point of purchase. The scope of Premium Services may be varied by the Operator on reasonable notice.

"NFT Verification" means the alternative mechanism by which Premium Services may be unlocked through server-to-server verification of a qualifying third-party "JokerX" non-fungible token, followed by entry of a one-time confirmation code. You acknowledge that NFT Verification does not require and does not involve connecting any cryptocurrency wallet within the Service, that the underlying token and its verification are operated by the third-party JokerX system, and that the Operator merely relies upon the verification result returned by that system. The Operator makes no representation as to the value, transferability, or continued availability of any such token.

"Referral Programme" means the arrangement under which a User may share a personal referral link and, subject to the applicable programme rules, become eligible for commissions in respect of qualifying activity attributable to that link. You acknowledge that referral commissions are calculated, determined, and settled by the third-party JokerX system and not by the Operator, and that the Operator does not guarantee the payment, timing, or amount of any commission. Participation in the Referral Programme is subject to the additional conditions published for that programme.

"Distribution Channels" means the means by which the Service is made available, namely the direct download of the Android application package from the Operator's website, the installable progressive web application for iPhone and iPad, and the browser-based web client. You acknowledge that the direct-download path is not distributed through the Apple App Store or Google Play, that you are responsible for permitting installation from such a source on your device, and that the ordinary store-based review, refund, and update mechanisms do not apply to that path. Updates for the direct-download path are delivered by the Operator through the Service itself.

"Contacts Matching" means the optional feature by which the Service identifies which of your contacts also use MakZens by comparing cryptographically hashed representations of email addresses rather than plaintext address-book data. You acknowledge that matching is performed on the basis of such hashed identifiers, that the feature is intended to limit the exposure of contact information, and that its use is subject to the further detail set out in the Privacy Policy. Contacts Matching operates only in respect of contacts you choose to make available for that purpose.

"Applicable Data Protection Law" means all laws and regulations relating to the processing of personal data that apply to the Operator or to you in connection with the Service, including in particular Regulation (EU) 2016/679 (the General Data Protection Regulation) where Users are located in the European Union or European Economic Area, and Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data of the United Arab Emirates. The terms "personal data", "processing", "data controller", and "data processor" bear the meanings given to them under the Applicable Data Protection Law. Where different data protection regimes apply concurrently, each shall apply to the categories of User and processing within its respective scope.

"Push Notification" means an alert delivered to your device to inform you of activity within the Service, such as a new message. You acknowledge that, to protect the confidentiality of your communications, a push payload carries only the identity of the sender and a generic placeholder rather than the substance of the message, and that the readable content is retrieved by the App on your device after the notification is received. This design reflects the Operator's commitment to limiting the transmission of message substance through third-party notification infrastructure.

"Confidential Information" means any non-public information disclosed by one party to the other in connection with the Service that is identified as confidential or that ought reasonably to be understood to be confidential given its nature or the circumstances of disclosure, but excludes information that is or becomes public other than through a breach of this Agreement. Nothing in this definition limits either party's obligations in respect of personal data, which are governed by the Applicable Data Protection Law and the Privacy Policy. Confidential Information may be used solely for the purposes of performing under, or exercising rights under, this Agreement.

This Agreement, and any dispute or claim arising out of or in connection with it or its subject matter or formation, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. Subject to any mandatory consumer-protection or data-protection rights that you may enjoy under the law of your place of residence, the courts of Dubai, United Arab Emirates shall have jurisdiction to settle any such dispute. Nothing in this clause deprives an EU or EEA User of the protection afforded by provisions that cannot be derogated from by agreement under the law of their habitual residence.

In this Agreement, unless the context otherwise requires, headings are for convenience only and do not affect interpretation; words in the singular include the plural and vice versa; references to a person include natural and legal persons; and the words "including", "includes", and "in particular" are illustrative and do not limit the generality of the preceding words. A reference to a statute, regulation, or third-party service, including any Translation Processor, the Payment Processor, or the JokerX system, is to that statute, regulation, or service as amended, replaced, or superseded from time to time. Any obligation not to do something includes an obligation not to permit or suffer that thing to be done, and where a term is defined, its cognate expressions bear a corresponding meaning.

By downloading, installing, accessing or using MakZens, whether through the direct Android application package (APK) obtained from our website, the installable progressive web application (PWA) added to an iPhone or iPad home screen, or the browser-based web client, you enter into a legally binding agreement with JXMSN LLC, PO Box 393394, Dubai, United Arab Emirates (the "Operator", "we" or "us"). These Terms and Conditions govern your use of the MakZens real-time translation messaging service, including all associated features, and constitute the entire agreement between you and the Operator with respect to the service. If you do not agree to be bound by these Terms, you must not install, access or use MakZens in any form.

Your acceptance of these Terms is expressed through affirmative conduct as well as by any express confirmation presented during onboarding. Completing account registration, sideloading and launching the APK, installing the PWA, sending or receiving a translated message, or otherwise using any function of MakZens each constitutes your unqualified acceptance of these Terms and of the MakZens Privacy Policy, which is incorporated herein by reference. Where an express "I accept" mechanism is presented, clicking or tapping it has the same binding effect as a handwritten signature under applicable law.

A central and non-severable characteristic of MakZens is that messages you send are automatically translated in real time by third-party artificial intelligence and large language model providers acting as translation processors, and by accepting these Terms you acknowledge and consent to this data flow. To perform translation, the textual content of your messages, together with the necessary source and target language metadata, is transmitted to these external providers, and both the original and the translated text are processed and delivered. If you do not consent to your message content being handled by such third-party translation processors, MakZens is not suitable for you and you must not use it.

MakZens is intended solely for natural persons who are at least sixteen (16) years of age, this being the minimum age of digital consent under Article 8 of the EU General Data Protection Regulation absent a lower national threshold. Where the law of your country of residence or nationality sets a higher minimum age for entering into a binding contract or for consenting to the processing of personal data, that higher age shall apply to you. By accepting these Terms you represent and warrant that you meet the applicable minimum age and that no legal impediment prevents you from using the service.

If you are a minor above the applicable minimum age but below the age of majority in your jurisdiction, you may use MakZens only with the prior consent and under the supervision of a parent or legal guardian who has read and agreed to these Terms on your behalf and who accepts responsibility for your use of the service. The Operator does not knowingly permit the creation of accounts by children below the minimum age of digital consent. If we become aware that a person below the applicable minimum age has registered, we will suspend the account and delete the associated personal data in accordance with the Privacy Policy and applicable law.

By accepting these Terms you represent and warrant that you possess the full legal capacity to enter into a binding contract, that all registration information you provide is true, current and complete, and that you will keep such information accurate. You further represent that you are not a person barred from receiving the service under the export-control, sanctions or other applicable laws of the United Arab Emirates or of any other jurisdiction to which you are subject. Any account created on the basis of false, misleading or incomplete eligibility information may be suspended or terminated without notice.

MakZens serves a global audience that expressly includes users located in the European Union and European Economic Area, whose personal data is processed in accordance with the General Data Protection Regulation, and users located in the United Arab Emirates, whose personal data is processed in accordance with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the UAE PDPL). By accepting these Terms you acknowledge that, irrespective of your location, your personal data may be transferred to and processed in jurisdictions outside your own, including by the third-party translation, payment and infrastructure providers engaged by the Operator. The safeguards applicable to such transfers are described in the Privacy Policy.

You acknowledge that the optional contacts-matching feature, which helps you discover which of your contacts already use MakZens, operates by comparing cryptographically hashed representations of email addresses rather than by transmitting the addresses in clear form. By enabling this feature you represent that you have a lawful basis to submit the contact information concerned and, where required by the GDPR, the UAE PDPL or other applicable law, that you have obtained any necessary consent from the individuals to whom that information relates. The Operator processes only the hashed values for matching purposes and does not use them to build a profile of non-users.

You acknowledge and accept the specific distribution model of MakZens, under which the Android application is delivered as a direct APK download from our website and the iPhone and iPad experience is provided as an installable progressive web application, meaning that MakZens is not distributed through the Apple App Store or Google Play for the direct-download path. Installing an APK from outside an official application store may require you to adjust device security settings, and you assume responsibility for doing so in a manner consistent with your device manufacturer's guidance and your own risk assessment. The Operator provides the APK and PWA solely from its official channels, and you must not install any build of MakZens obtained from a source other than the official website.

If you elect to purchase a MakZens premium plan, whether a one-time purchase or a recurring subscription, you agree that payment is made in USDC stablecoin on the Solana or BSC network and is processed by NowPayments, a third-party payment processor, subject to that processor's own terms and privacy practices. You acknowledge and agree that the Operator does not custody cryptocurrency, does not provide any wallet, exchange, brokerage, investment or financial-advisory service, and bears no responsibility for the operation of any blockchain network, wallet software, or third-party processor. Acceptance of these Terms includes acceptance of this payment arrangement and of the volatility, irreversibility and network risks inherent in blockchain-based payments.

As an alternative means of unlocking premium features, MakZens supports verification of a third-party "JokerX" non-fungible token (NFT) through a server-to-server ownership check combined with a one-time confirmation code, a process that deliberately requires no connection of any cryptocurrency wallet within the application. By using this unlock method you represent that you are the legitimate holder of the relevant JokerX NFT and that your use of it for this purpose does not violate the terms of any third party. The Operator neither issues, endorses, values nor guarantees the JokerX NFT and disclaims all liability arising from the third-party systems on which such verification depends.

If you participate in the MakZens referral programme by sharing your personal referral link, you acknowledge that any commissions are calculated and settled by the third-party JokerX system and not by the Operator, and that your participation is subject to any additional terms imposed by that system. You agree to promote MakZens only through lawful, non-deceptive means, and you must not engage in spam, self-referral, fraudulent sign-ups or any other manipulation of the referral mechanism. The Operator reserves the right to withhold or reverse referral benefits, and to exclude you from the programme, where abuse is reasonably suspected.

You accept that MakZens offers a broad range of communication features, including one-to-one chats, group chats, public and private channels, voice messages, voice and video calls, photo and file sharing, location sharing, message reactions, replies, editing, disappearing messages, message deep links and multi-device access via QR-code web login, and that your use of each such feature is governed by these Terms. Certain features necessarily involve the transmission of your content and metadata to other users and to the Operator's processors as required to deliver the feature. By using any feature you consent to the processing reasonably necessary for its operation, including the real-time translation of textual content described above.

You acknowledge that push notifications delivered by MakZens are designed to protect the confidentiality of your conversations, such that the push payload transmitted through the mobile operating system's notification service carries only the sender identifier and a generic placeholder rather than the substantive message text, with the actual content being retrieved and decrypted on your device after delivery. By enabling notifications you consent to the routing of these minimal payloads through the applicable third-party push infrastructure. You remain responsible for the security of any device on which notifications are displayed.

You agree that your use of MakZens shall at all times comply with these Terms, with the MakZens Acceptable Use rules, and with all laws applicable to you, and that you will not use the real-time translation, messaging or file-sharing features to transmit unlawful, infringing, harassing or otherwise prohibited content. Your eligibility to use the service is conditional on continued compliance, and any material breach of these Terms may result in the immediate suspension or termination of your account at the Operator's discretion. Termination for breach does not entitle you to any refund of amounts already paid through NowPayments.

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by and construed in accordance with the laws in force in the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and you submit to the jurisdiction of the competent courts of Dubai for the resolution of any dispute, subject to any mandatory consumer-protection or data-protection rights that the GDPR, the UAE PDPL or the law of your place of residence confers on you and that cannot lawfully be excluded. Nothing in this clause deprives a consumer of the protection of the mandatory provisions of their local law. Any statutory rights you enjoy as a data subject under the GDPR or the UAE PDPL remain fully reserved.

The Operator may amend these Terms from time to time to reflect changes in the service, in the third-party translation, payment or verification providers it engages, or in applicable law, and will make the revised Terms available within the application and on the MakZens website with an updated effective date. Where an amendment materially affects your rights, we will provide reasonable advance notice by in-app notification or other appropriate means, and your continued use of MakZens after the amendment takes effect constitutes acceptance of the revised Terms. If you do not accept a material amendment, your sole remedy is to cease using the service and, where applicable, to close your account; questions regarding these Terms or your eligibility may be directed to [insert contact address, e.g. legal@makzens.app].

To create an account with MakZens, you must register by providing a valid email address and any other information requested during the sign-up flow operated by JXMSN LLC. Registration is available through the browser web client, through the installable web application (PWA) on iPhone and iPad, and through the Android application distributed as a direct APK download from the MakZens website rather than through the Apple App Store or Google Play. By completing registration you confirm that the information you provide is true, accurate, current and complete, and you undertake to keep it updated for as long as your account remains active.

You must be at least the age of digital consent applicable in your jurisdiction to open and operate a MakZens account, which is 16 years (or such lower age as permitted by an EU or EEA Member State under the General Data Protection Regulation) for users in the EU/EEA and 18 years for users in the United Arab Emirates unless a lower age is lawfully permitted under the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021). Where a user is below the applicable age, an account may only be created and operated with the verifiable consent and supervision of a parent or legal guardian who accepts these Terms on the user's behalf. JXMSN LLC may suspend or delete any account where it reasonably believes the applicable minimum age requirement has not been met.

Each account is personal to the registered user, and you may not create an account on behalf of any other person, entity or automated agent without their express authorisation and our prior written consent. You may not maintain multiple accounts for abusive, deceptive or fraudulent purposes, including the artificial generation of referral commissions, the circumvention of premium payment obligations, or the evasion of a prior suspension or ban. JXMSN LLC reserves the right to limit the number of accounts associated with a single user, device or email address.

You are solely responsible for maintaining the confidentiality of your login credentials, any authentication codes, and any active session tokens associated with your account, including sessions established on secondary devices. You agree not to disclose your credentials to any third party and to use only genuine MakZens software obtained from the official website; because the Android client is distributed as a direct APK, you are responsible for verifying that you download it from the authentic MakZens domain and not from a repackaged or tampered source. Any activity occurring under your credentials or sessions is presumed to be your own unless you demonstrate that your account was accessed without your authorisation.

MakZens supports multi-device access, including linking a browser or web session to your primary account by scanning a QR code (QR web login). When you link a device you authorise that device to send, receive, decrypt for display, and store messages and account data on your behalf, and you remain responsible for all activity conducted through each linked session. You should link only devices that you own or control, and you agree to unlink or revoke any device that is lost, sold, shared or no longer under your control without delay.

You must promptly notify JXMSN LLC at [security@makzens.app] if you become aware of, or reasonably suspect, any unauthorised access to your account, loss or theft of a device holding an active session, or any other breach of account security. Upon receiving such notice, or upon detecting suspicious activity itself, JXMSN LLC may take protective measures including terminating active sessions, requiring re-authentication, temporarily suspending the account, or requesting additional verification. JXMSN LLC shall not be liable for any loss arising from unauthorised use of your account that occurs before you notify us and we have had a reasonable opportunity to act.

The MakZens contacts matching feature identifies other registered users known to you by comparing hashed (irreversible) representations of email addresses rather than the addresses in plain text. By enabling contacts matching you confirm that you are entitled to submit the relevant contact information for this limited matching purpose, and you acknowledge that this processing is described further in the Privacy Policy and is carried out in accordance with the GDPR and the UAE PDPL. You may disable contacts matching at any time through the application settings, subject to the resulting loss of the corresponding discovery functionality.

You acknowledge and agree that MakZens is a cross-language messenger and that, by default, the text of messages you send and receive is automatically transmitted to third-party artificial intelligence and large language model providers acting as translation processors for the sole purpose of generating real-time translations. Both the original text and the translated text are handled to deliver this feature, and by maintaining an account and sending translatable content you consent to this processing as described in the Privacy Policy. If you do not wish particular content to be transmitted to a translation processor, you must refrain from sending that content through a translation-enabled conversation.

Push notifications delivered to your registered devices are designed to protect the confidentiality of your communications: the push payload carries only the sender identifier and a generic placeholder rather than the message content, and the notifying device retrieves and renders the actual text on-device after authentication. You are responsible for configuring the notification and operating-system permissions on each of your devices, and you acknowledge that notification content and behaviour may vary by platform, particularly between the Android APK client and the iOS PWA. Disabling notifications at the device or operating-system level may affect your ability to receive timely alerts of new messages, calls or account-security events.

Your account may be used to access optional premium plans, offered as one-time purchases or recurring subscriptions, with payment made in USDC stablecoin on the Solana or BSC networks and processed by the third-party payment processor NowPayments. JXMSN LLC does not custody cryptocurrency and does not provide any wallet, exchange, investment, brokerage or financial-advisory service; you are solely responsible for the security of your own wallet, keys and on-chain transactions, and for sending payment to the correct address and network. Premium entitlements are linked to your account, and JXMSN LLC is not responsible for funds lost due to user error, network selection mistakes, or issues arising within the third-party payment processor or blockchain networks.

As an alternative route to unlocking premium features, MakZens supports verification of a third-party JokerX NFT through a server-to-server check combined with a one-time confirmation code, without connecting any wallet within the application. You represent that any NFT and confirmation code you present for verification are genuine and lawfully held by you, and you acknowledge that the associated entitlement depends on the availability and integrity of the external JokerX system. JXMSN LLC may revoke a premium entitlement granted on this basis if the underlying verification is later found to be invalid, fraudulent or revoked at source.

If you participate in the MakZens referral programme, a personal referral link is associated with your account, and any commissions arising from valid referrals are calculated and settled by the third-party JokerX system rather than directly by JXMSN LLC. You agree not to promote your referral link through spam, misrepresentation, self-referral, or any deceptive practice, and you acknowledge that eligibility, tracking and payout of commissions are subject to the rules and availability of the JokerX system. JXMSN LLC may suspend referral functionality on an account, or withhold associated benefits, where it reasonably suspects abuse or fraud.

You agree to use your account only for lawful purposes and in compliance with these Terms, our Acceptable Use policy, and all applicable laws, including the laws of the United Arab Emirates and any laws applicable to you in your own place of residence. You must not use your account to transmit unlawful, infringing, harassing or abusive content, to attempt to defeat or reverse-engineer the translation, encryption or authentication mechanisms, or to interfere with the operation, integrity or security of the MakZens platform. Group chats, public and private channels, voice and video calls, voice messages, and file, photo and location sharing are provided subject to these same obligations.

You are responsible for the accuracy and lawfulness of all content associated with your account, including messages, replies, reactions, edited messages, disappearing messages, shared files and shared locations, and you retain responsibility for such content even where automated translation is applied. You acknowledge that translated output is generated by third-party AI systems and may contain inaccuracies, and that JXMSN LLC does not warrant the correctness of any translation; you should exercise independent judgement before relying on translated content in any sensitive, legal, medical or financial context. Where disappearing messages or message editing are used, you acknowledge that recipients and their devices may retain copies outside our control.

JXMSN LLC processes the personal data associated with your account as a data controller in accordance with its Privacy Policy, the GDPR (for users in the EU/EEA) and the UAE PDPL, and you may exercise your applicable rights, including rights of access, rectification, erasure, restriction, objection and portability, by contacting [privacy@makzens.app]. You acknowledge that the operation of your account necessarily involves disclosures to sub-processors, including third-party translation providers, the NowPayments payment processor, and push-notification infrastructure, each engaged for the specific purposes described in the Privacy Policy. Where cross-border transfers of personal data occur, they are carried out subject to appropriate safeguards as required by applicable data protection law.

You may deactivate or delete your MakZens account at any time through the application settings or by contacting [support@makzens.app], and upon deletion JXMSN LLC will cease active processing of your account data and delete or anonymise it in accordance with the Privacy Policy, subject to retention required by law or for the establishment, exercise or defence of legal claims. Certain data that has already been transmitted to third parties, such as translated message content processed by translation providers, messages received by other users, or on-chain payment records, may persist outside JXMSN LLC's control and cannot be recalled. Deletion of your account does not entitle you to a refund of any premium purchase except where required by mandatory law.

JXMSN LLC may suspend, restrict or terminate your account, with or without prior notice where circumstances reasonably require, if you breach these Terms, if your account is used unlawfully or fraudulently, if required by a competent authority, or if continued provision would expose JXMSN LLC or its users to material legal, security or reputational risk. These Terms, and all matters relating to your account, registration and account security, are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and the courts of Dubai, United Arab Emirates shall have jurisdiction, without prejudice to any mandatory consumer or data-protection rights available to you under the law of your place of residence. JXMSN LLC (registered at PO Box 393394, Dubai, United Arab Emirates, [insert registration number]) may update these account provisions from time to time, and your continued use of the account after such changes take effect constitutes acceptance of the updated terms.

Subject to your continued compliance with these Terms and Conditions, JXMSN LLC, a company established in Dubai, United Arab Emirates with registered office at PO Box 393394, Dubai, United Arab Emirates (the "Operator", "we" or "us"), grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install, access and use the MakZens messaging application (the "App") on devices that you own or lawfully control. This licence extends to each of the supported distribution channels, namely the Android application package (APK) offered as a direct download from our website, the installable progressive web application (PWA) for iPhone and iPad, and the browser-based web client. The licence is granted solely for your private, personal, non-commercial communication use unless a separate written commercial arrangement has been agreed with us.

The App is intended to be obtained only through our official channels, being the APK made available for direct download at [insert official website URL], the PWA installed from that same website, and the web client served from our authorised domains. Because the Android build is distributed as a direct APK download and not through the Apple App Store or Google Play, you acknowledge that no third-party application store reviews, hosts or vouches for that build, and you agree to install it only from our genuine source. You must not download, install or run any copy of the App obtained from an unofficial repository, mirror, file-sharing site or repackaging service, and we accept no responsibility for modified, cracked or maliciously altered builds obtained outside our channels.

Where you install the Android APK, your device operating system may warn you about installing applications from outside an application store and may require you to enable installation from unknown or untrusted sources. You are responsible for understanding and accepting the security implications of enabling such settings, for verifying that the APK originates from us, and, where we publish them, for checking any file checksums or signing information we provide. We recommend that you restore your device to its default installation-security settings after installing or updating the App, and we shall not be liable for consequences arising from configuration changes you make to your own device.

The App includes an in-application and over-the-air update mechanism, and it periodically checks a version endpoint to determine whether a newer release is available. You acknowledge that updates, patches, delta packages and security fixes may be delivered to the APK and PWA builds and that certain updates may be applied automatically or may be required in order to continue using the App. We may condition continued access on your acceptance and installation of a mandatory update, in particular where such update is necessary to preserve security, legal compliance or interoperability with our servers.

The core function of the App is cross-language messaging in which every message is automatically translated in real time. You expressly acknowledge and consent that, in order to provide this function, the text of your messages together with the necessary context is transmitted to and processed by third-party artificial intelligence and large-language-model providers acting as translation processors, and that both your original text and the resulting translated text are handled to deliver the message. This translation function is fundamental to the licence granted, and by using the App you authorise the routing of message content to such third-party translation processors for the sole purpose of performing translation.

Machine translation is inherently imperfect, and the licence to use the App is granted on the express understanding that translated output is provided on an "as available" basis and may contain inaccuracies, omissions, ambiguities or context errors. You must not rely on the App's automated translations for any purpose where an error could cause harm, including without limitation medical, legal, financial, safety-critical, emergency or contractually binding communications, without independent professional verification. You remain solely responsible for the meaning, accuracy and consequences of the messages you send and of your reliance on any translation produced by the App.

Your licence to use the App encompasses its features as made available from time to time, including one-to-one chats, group chats, public and private channels, voice messages, voice and video calls, photo and file sharing, location sharing, message reactions, replies, editing, disappearing messages, contacts matching, push notifications, message deep links and multi-device access via QR-code web login. We may add, modify, suspend or withdraw any feature, channel or platform at our discretion, and no particular feature is guaranteed to remain available for the duration of your use. Availability of specific features may further depend on your device, operating system, network conditions and the distribution channel through which you access the App.

The contacts-matching feature operates by comparing hashed representations of email addresses so that you may discover which of your contacts already use MakZens without our receiving your contacts' addresses in plain form. By enabling this feature you represent that you have a lawful basis to submit the relevant contact information and, where required, that you have obtained any necessary consent from the individuals concerned. You must not use the contacts-matching, channel, deep-link or messaging features to send unsolicited bulk communications, to harvest user data, or otherwise in breach of applicable anti-spam and data-protection law.

The App supports optional premium plans, offered as both one-time purchases and recurring subscriptions, which unlock additional functionality under the licence granted herein. Payment for premium plans is made in USDC stablecoin on the Solana or BSC networks and is processed exclusively by NowPayments, a third-party payment processor, subject to that processor's own terms and conditions. The Operator does not custody, hold, control, exchange or invest cryptocurrency, provides no wallet, exchange, brokerage, investment or financial-advisory service, and your use of any blockchain network or third-party wallet to effect payment is entirely at your own risk and responsibility.

As an alternative means of unlocking premium functionality, the App supports verification of a third-party "JokerX" non-fungible token by way of a server-to-server check combined with a one-time confirmation code, without any wallet connection being made within the App. You acknowledge that JokerX and any associated NFT are operated and controlled by third parties, that we do not issue, endorse, value or guarantee any such token, and that the availability and outcome of any verification depend on those third-party systems. We may modify or discontinue the JokerX verification path at any time and accept no liability for the conduct, solvency or continued operation of the JokerX system or its operators.

The App offers a referral programme under which partners may share a personal referral link, with any commissions or rewards being calculated and settled by the third-party JokerX system rather than by the Operator. Participation in the referral programme is subject to any separate programme rules we or the JokerX operator may publish, and we make no representation or warranty as to the amount, timing, payment or continued availability of any referral commission. You must present your referral link truthfully and must not engage in misleading, fraudulent, self-referring or otherwise abusive referral practices, and we may suspend your access to referral features in the event of suspected abuse.

This licence does not transfer to you any ownership of the App, and all intellectual property rights in and to the App, its software, interfaces, trade marks, look and feel, and underlying technology remain vested in the Operator and its licensors. You must not copy, modify, adapt, translate, reverse engineer, decompile, disassemble, decrypt, extract source code from, create derivative works of, or otherwise attempt to derive the internal workings of the App, save to the extent that such restriction is expressly prohibited by applicable mandatory law. You must not remove, obscure or alter any proprietary notice, signature or attribution contained within the APK, PWA or web client.

In using the App under this licence you must not upload, transmit, translate, store or share any content that is unlawful, defamatory, infringing, obscene, harassing, hateful, or that constitutes child sexual abuse material, incitement to violence, or a breach of any third party's rights. You must not use the App to distribute malware, to circumvent our security or access controls, to interfere with our servers or the translation, payment or verification services on which the App relies, or to gain unauthorised access to any account, channel or system. We may remove content, and suspend or terminate your access, where we reasonably consider that your use violates these Terms or applicable law.

The multi-device feature permits you to link additional sessions, including the browser web client, by scanning a QR code to establish an authenticated session. You are responsible for safeguarding your credentials, confirmation codes, linked-device sessions and any device on which the App is installed, and for promptly unlinking sessions on devices you no longer control. You must not authorise a device or session on behalf of a person who is not entitled to access your account, and you accept responsibility for all activity conducted through sessions you have linked until you revoke them.

The App is intended for use by a global audience, including data subjects in the European Union and European Economic Area whose personal data is protected under the General Data Protection Regulation (GDPR) and individuals in the United Arab Emirates whose personal data is protected under Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the UAE PDPL). Your use of the App, and our processing of personal data in connection with the messaging, translation, contacts-matching, push-notification and payment functions, is described in and governed by our Privacy Policy, which forms an integral part of these Terms. You acknowledge that message content is transmitted to third-party translation providers to perform translation, that push notification payloads carry only the sender identity together with a generic placeholder rather than message content, that contacts are matched using hashed email values, and that payment is handled by NowPayments while the Operator maintains no custody of cryptocurrency.

The licence granted under this section may be suspended or terminated by us with immediate effect where you materially breach these Terms, where required by law or by a competent authority, or where continued provision would expose us or other users to legal, security or reputational risk; you may terminate the licence at any time by ceasing to use and uninstalling the App. Upon termination you must stop using the App and delete all copies of the APK and any installed PWA within your control, and Sections concerning intellectual property, disclaimers, limitation of liability and governing law shall survive. Termination does not entitle you to any refund of premium fees except to the extent required by applicable mandatory consumer-protection law.

This licence and these Terms and Conditions are governed by, and shall be construed in accordance with, the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-laws principles, and the courts of Dubai, United Arab Emirates shall have exclusive jurisdiction over any dispute arising out of or in connection with the App, save where mandatory consumer-protection or data-protection law confers on you a non-excludable right to bring proceedings in, or to benefit from the protections of, your country of habitual residence. Nothing in this governing-law provision deprives EU/EEA consumers or UAE data subjects of the mandatory protections afforded to them under the GDPR or the UAE PDPL respectively. You agree to use MakZens only for lawful communication and only in a manner consistent with these Terms, the documentation published on the MakZens website, and all applicable laws of the United Arab Emirates and of any other jurisdiction from which you access the Service. You must not use the Service in any way that violates UAE Federal Decree-Law No. 34 of 2021 on Combatting Rumours and Cybercrimes, the EU General Data Protection Regulation (GDPR) where it applies to you, or UAE Federal Decree-Law No. 45 of 2021 (PDPL). Because MakZens is operated by JXMSN LLC from Dubai and is governed by the laws of Dubai, United Arab Emirates, you accept that content or conduct lawful elsewhere may still be prohibited here.

You must not transmit, translate, store, or share any content that is unlawful, defamatory, obscene, hateful, harassing, threatening, or that incites violence, terrorism, or discrimination. This restriction applies equally to the original text you compose and to any machine-translated output produced from it, and you remain solely responsible for both the source message and its translated form. You acknowledge that a translation generated on your behalf does not transfer responsibility for the underlying content to MakZens or to any translation processor.

You acknowledge that every message you send is automatically transmitted in real time to third-party artificial-intelligence and large-language-model providers acting as translation processors in order to generate the translated text, and you must not submit content that you are not entitled to disclose to such external processors. You must not use the translation feature to relay trade secrets, classified information, regulated personal data, or other material whose transmission to a third-party processor would breach a confidentiality obligation or data-protection duty owed by you. Where GDPR or the UAE PDPL applies to personal data contained in your messages, you warrant that you have a lawful basis for that data being processed and translated in this manner.

You must not use MakZens to distribute malware, ransomware, spyware, or any code designed to disrupt, damage, or gain unauthorised access to any system, and you must not attempt to probe, scan, or circumvent the security of the Service or its infrastructure. This prohibition expressly extends to the voice message, voice and video calling, photo and file-sharing, and location-sharing features, which must not be used to deliver malicious payloads or to conduct surveillance without lawful authority. Any file you share must be one you are legally permitted to distribute.

You must obtain the direct APK for Android or install the iPhone and iPad progressive web app (PWA) only from the official MakZens website, and you must not redistribute, repackage, decompile, tamper with, or sideload modified builds of the application. Because the direct-download and PWA distribution paths do not rely on the Apple App Store or Google Play review process, you accept responsibility for verifying that installation on your device is lawful in your jurisdiction and consistent with your device manufacturer's terms. You must not represent any unofficial or altered build as an authentic MakZens client.

You must not use the contacts-matching feature, which operates by matching hashed email addresses, to build, enrich, scrape, or resell contact databases, nor to determine another person's use of MakZens for harassment, stalking, or unsolicited bulk outreach. You warrant that you are entitled to submit the email addresses you allow to be hashed and matched, and that doing so complies with GDPR, the UAE PDPL, and any anti-spam laws applicable to you. You must not attempt to reverse, de-hash, or otherwise re-identify the hashed values used by the matching process.

You must not use MakZens to send spam, chain messages, or unsolicited commercial communications, and you must not abuse the public and private channel, group chat, or message deep-link features to distribute bulk unsolicited content or to lure users to fraudulent destinations. Message deep links must not be crafted to impersonate MakZens, to phish credentials, or to disguise the true destination of a link. Operators of public channels are responsible for moderating content they broadcast and must not knowingly amplify prohibited material.

You must not impersonate any person, brand, or organisation, misrepresent your affiliation with JXMSN LLC, or use another individual's identity, likeness, or account without authorisation. The multi-device feature accessed by QR-code web login is provided for your own use across your own devices, and you must not use it to obtain or maintain unauthorised access to an account that is not yours. You are responsible for safeguarding your QR-login sessions and for terminating any device session you no longer control.

You must not exploit, tamper with, or misrepresent the premium purchase flow, which is settled in USDC stablecoin on the Solana or BSC networks and processed by the third-party payment processor NowPayments. You acknowledge that JXMSN LLC does not custody cryptocurrency and provides no wallet, exchange, investment, brokerage, or financial-advisory service, and you must not treat, describe, or use the Service as if it did. You bear sole responsibility for the accuracy of the wallet, network, and transaction details you use, and for any loss arising from an incorrect address, wrong network selection, or an irreversible on-chain transfer.

You must not engage in money laundering, terrorist financing, sanctions evasion, or any other unlawful financial activity through the payment or referral facilities of the Service, and you must not initiate premium payments using funds derived from criminal conduct. You warrant that you are not a person, and are not acting on behalf of any person, subject to sanctions administered by the United Arab Emirates, the United Nations, or other applicable authorities. JXMSN LLC may suspend or reverse premium access where a payment is flagged by NowPayments or is reasonably suspected of being connected to unlawful conduct.

You must not manipulate, defraud, or abuse the alternative premium unlock, which operates by verifying a third-party JokerX NFT through a server-to-server check together with a one-time confirmation code. You must not submit a confirmation code you did not lawfully obtain, share or resell such codes, verify an NFT you do not genuinely control, or attempt to spoof or replay the server-to-server verification. Any premium entitlement obtained through misrepresentation of JokerX NFT ownership may be revoked without refund.

You must not abuse the referral programme, under which partners share a personal link and commissions are settled by the third-party JokerX system, through self-referral, fabricated sign-ups, bots, incentivised fraud, or any other artificial inflation of referrals. You must present referral links honestly and must not make misleading claims about MakZens, its premium features, or expected earnings when promoting your link. You acknowledge that commission calculation, eligibility, and settlement are administered by the JokerX system and that JXMSN LLC may withhold or claw back commissions attributable to prohibited conduct.

You must not use the disappearing-messages, edit, reaction, reply, or message-recall features to destroy, alter, or conceal content in a manner intended to obstruct a lawful investigation, defeat a legal preservation obligation, or perpetrate fraud against another user. You acknowledge that disappearing messages are a convenience feature and not a guarantee that recipients cannot retain, screenshot, or otherwise preserve a message, and you must not rely on them to satisfy any statutory record-keeping or deletion duty. You remain responsible for your own compliance with retention and erasure obligations under GDPR, the UAE PDPL, or other applicable law.

You must not use the voice and video calling features to record another participant without the consent required by the law applicable to that participant, nor to intercept communications unlawfully. Location sharing must be used only with the informed agreement of those to whom you disclose your location, and you must not use it to track, monitor, or endanger any person against their will. You are solely responsible for ensuring that your recording, monitoring, and location-sharing activities comply with the privacy and consent laws of every relevant jurisdiction.

You must not exploit MakZens to infringe the intellectual-property rights of others, including by sharing, translating, or channel-broadcasting copyrighted works, trademarks, or counterfeit goods without authorisation. You retain responsibility for content you route through the third-party translation processors, and you warrant that such transmission does not infringe any third party's rights. Upon a valid rights-holder complaint, JXMSN LLC may remove infringing content and restrict the responsible account.

You must not use automated means, including bots, scrapers, or scripted clients, to access the Service, create accounts in bulk, generate messages, exhaust translation capacity, or otherwise place an unreasonable or disproportionate load on the infrastructure or on the third-party translation, payment, or verification providers. You must not circumvent rate limits, usage quotas, or technical access controls, and you must not resell, sublicense, or provide the Service to third parties as a commercial relay without prior written authorisation from JXMSN LLC. Reverse engineering of the client is permitted only to the narrow extent that mandatory applicable law renders such a restriction unenforceable.

JXMSN LLC reserves the right, at its sole discretion and without prior notice where the circumstances reasonably require, to investigate suspected breaches of this section and to suspend, restrict, or terminate access to MakZens, to individual features, or to premium entitlements. Where conduct appears unlawful, JXMSN LLC may report it and disclose relevant information to competent authorities in the United Arab Emirates or elsewhere, subject to applicable data-protection law including GDPR and the UAE PDPL. Any questions regarding acceptable use, or reports of prohibited conduct, may be directed to [insert contact address, e.g. abuse@makzens.app], and enforcement of these Terms is governed by the laws of Dubai, United Arab Emirates.

You retain all ownership rights that you already hold in the text, voice messages, photographs, files, location data and other material that you create, upload, transmit or otherwise make available through MakZens (collectively, your "User Content"). By submitting User Content you grant JXMSN LLC a limited, non-exclusive, royalty-free, worldwide licence to host, store, reproduce, transmit, display and route that content solely to the extent technically necessary to operate the messaging service, deliver your messages to their intended recipients and provide the features you use. This licence does not transfer ownership, is granted only for the purpose of running the Service, and terminates when the content is deleted from our systems, subject to residual copies held for the limited periods described in the Privacy Policy.

You expressly acknowledge and agree that MakZens performs automatic cross-language translation of messages, and that in order to do so the original text of your messages is transmitted to independent third-party artificial-intelligence and large-language-model providers acting as translation processors. By sending, receiving or enabling translation of a message you instruct JXMSN LLC to disclose the original and, where applicable, previously translated text to those processors for the sole purpose of generating a translation. You are solely responsible for the content you choose to send in the knowledge that it will be processed by such third parties, and you must not transmit content through the Service that you are not permitted to disclose to an external translation processor.

Automated machine translation is provided on an "as is" basis and may be inaccurate, incomplete, contextually wrong or misleading. JXMSN LLC does not warrant the accuracy, fidelity or fitness for any purpose of any translated output, and you must not rely on translated messages for legal, medical, financial, contractual, safety-critical or other consequential decisions without independent human verification. You remain responsible for the meaning that you intend to convey and for any misunderstanding arising from your reliance on, or your recipient's reliance on, a machine-generated translation.

You are solely and fully responsible for all User Content and for all activity conducted through your account, whether accessed via the Android APK, the installable iOS/iPadOS progressive web application (PWA) or the browser web client, including sessions authorised on additional devices through QR-code web login. You must keep your account credentials and any linked-device sessions confidential, must promptly revoke any device you no longer control or recognise, and you accept responsibility for messages sent, purchases made and settings changed from any device linked to your account until such device is de-authorised.

You agree not to use MakZens to create, send, store, request or share any content or to engage in any conduct that is unlawful, fraudulent, defamatory, obscene, harassing, threatening, hateful, or that infringes the intellectual property, privacy or other rights of any person. You further agree not to transmit child sexual abuse material, content promoting terrorism or violence, malware, or content that violates the laws of the United Arab Emirates, of the Emirate of Dubai, or of any other jurisdiction from which you access or to which you direct the Service. You are responsible for ensuring that your use of the Service, including any content that is automatically translated, complies with all applicable laws in your location and in your recipients' locations.

Because MakZens is a communications platform on which messages pass directly between users, JXMSN LLC does not pre-screen, monitor or moderate User Content in the ordinary course, and it is neither the author nor the endorser of any User Content. We reserve the right, but assume no obligation, to review, refuse, restrict, remove or disable access to any User Content that we reasonably believe violates these Terms or applicable law, or that is the subject of a valid legal request, and we may do so without prior notice where necessary to comply with the law or to protect users or the Service.

You are responsible for lawfully holding any personal data of third parties that you introduce into the Service, including through the optional contacts-matching feature. You acknowledge that contacts matching operates by transmitting hashed representations of email addresses so that mutual contacts can be identified without our retaining your address book in cleartext, and you represent that you have any consent or other lawful basis required under the EU/EEA General Data Protection Regulation (GDPR) and the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) before you enable matching against other persons' contact details. You will indemnify JXMSN LLC against claims arising from your unlawful submission of third-party personal data.

You are responsible for configuring and using the Service's privacy and messaging features in a manner appropriate to your intended level of confidentiality, including disappearing messages, private versus public channels, group membership, replies, edits, reactions, message deep links and location sharing. You acknowledge that features such as message edit and disappearing messages operate on your own devices and the recipients' devices, that recipients may retain, screenshot, copy, forward or otherwise preserve content before it disappears or is edited, and that a message deep link may expose the existence of, or entry point to, a conversation to any person who obtains that link. JXMSN LLC is not responsible for a recipient's handling or onward disclosure of content you send them.

Where you participate in a public or private channel or a group chat, you are responsible for the content you post to, and for your conduct within, that space, and you acknowledge that other members and, in the case of public channels, non-members may view, translate, retain and redistribute your contributions. Channel and group administrators are responsible for the membership, purpose and moderation of the spaces they operate and act in their own capacity and not as agents of JXMSN LLC. JXMSN LLC does not endorse and is not liable for content posted by users in any channel or group.

Voice messages and voice or video calls carried over the Service, together with any photographs, files or location information you share, are your responsibility, and you must obtain any consent required by applicable law before recording, capturing, sharing or disclosing the voice, image, likeness or location of any other person. You are responsible for ensuring that you hold the necessary rights to any file, image or media you upload and for scanning files you receive, as JXMSN LLC does not warrant that files transmitted between users are free of malware or other harmful components.

Optional MakZens Premium is offered as one-time purchases and as subscriptions, and all payments are denominated and settled in USDC stablecoin on the Solana or BSC networks and processed exclusively by the third-party payment processor NowPayments. You are responsible for the accuracy of the payment details you submit, for the security of the wallet from which you pay, and for any network, gas or processor fees; JXMSN LLC does not custody, hold, control, exchange or invest crypto-assets on your behalf and provides no wallet, exchange, brokerage, investment or financial-advisory service. Blockchain transactions are irreversible, and once a payment is confirmed on-chain it cannot be recalled by JXMSN LLC; refunds, where offered at all, are governed by the separate refund provisions of these Terms.

As an alternative means of unlocking Premium, you may verify ownership of a third-party "JokerX" NFT through a server-to-server check followed by entry of a one-time confirmation code, without connecting any wallet within the application. You represent that any NFT you present for verification is lawfully yours, and you acknowledge that the issuance, value, transferability and continued validity of the JokerX NFT are governed by the third party operating that system and are outside the control of JXMSN LLC. JXMSN LLC is not responsible for the JokerX system's availability, for the outcome of any verification, or for any loss connected with your acquisition, holding or disposal of such NFT.

If you participate in the referral programme, you may share a personal referral link and any resulting commissions are calculated and settled by the third-party JokerX system and not by JXMSN LLC. You are responsible for promoting your referral link lawfully and truthfully, for making any disclosures required of you as a promoter, and for not engaging in spam, self-referral, misrepresentation or other abusive or fraudulent conduct; violation may result in forfeiture of commissions and termination of your participation. JXMSN LLC makes no representation as to the amount, timing or continued availability of any referral commission settled through the JokerX system.

You acknowledge that the Android application is distributed as a direct APK download from the MakZens website and the iOS/iPadOS application is distributed as an installable progressive web application, and that neither the direct-download Android build nor the PWA is obtained through the Apple App Store or Google Play. You are responsible for enabling installation from the website, for verifying that you download the application only from the official MakZens source, and for keeping your operating system and application up to date; JXMSN LLC is not responsible for any harm arising from your installation of a modified, repackaged or non-official build obtained from any source other than the official distribution channel.

You will indemnify, defend and hold harmless JXMSN LLC and its officers, employees and contractors from and against any claim, demand, liability, damage, loss, cost or expense (including reasonable legal fees) arising out of or connected with your User Content, your use or misuse of the Service, your violation of these Terms or of any applicable law, or your infringement of any right of a third party. This obligation extends to claims arising from content you routed through third-party translation processors, from your handling of other persons' personal data under the GDPR or the UAE PDPL, and from your participation in the referral, Premium payment or NFT-verification arrangements described above.

You are responsible for maintaining your own independent backups of any content you wish to preserve, and you acknowledge that message delivery, translation, voice and video calling, and file transfer depend on your device, your network connectivity and on third-party providers, and may be delayed, degraded or unavailable. Push notifications for new messages are designed to carry only the sender identifier together with a generic placeholder rather than the message content, so that message text is retrieved and, where applicable, translated only after the application is opened on your device; you remain responsible for the security of the device on which such content is displayed. JXMSN LLC does not guarantee uninterrupted, timely, secure or error-free operation of the Service.

These Terms, and any dispute, claim or matter arising out of or in connection with your User Content, your messages or your use of the Service, are governed by and construed in accordance with the laws applicable in the Emirate of Dubai, United Arab Emirates, and you submit to the jurisdiction of the competent courts of Dubai, without prejudice to any mandatory consumer or data-protection rights that you may enjoy under the GDPR in the EU/EEA or under other locally applicable law. Nothing in this section limits the rights and remedies available to you or to JXMSN LLC under the UAE PDPL or the GDPR, and JXMSN LLC may be reached in respect of the matters in this section at [insert registered contact address] or privacy@makzens.app. JXMSN LLC is registered at PO Box 393394, Dubai, United Arab Emirates under [insert registration number].

By composing, sending, or receiving messages through the MakZens Android application (distributed as a direct APK download), the installable iOS/iPadOS web application (PWA), or the browser web client, you acknowledge and agree that the automated translation of message content is a core and inseparable function of the service and cannot be selectively disabled while continuing to use cross-language communication features.

To perform real-time translation, the textual content of your messages, together with the original source text and the resulting translated text, is transmitted to and processed by third-party artificial intelligence and large language model providers acting as translation processors on behalf of JXMSN LLC. You expressly consent to this transmission and processing and understand that message text necessarily leaves the MakZens infrastructure and is handled by these external providers strictly for the purpose of generating translations and returning them to the intended recipients.

The translation of natural language is inherently imperfect, and automated AI systems may produce renderings that are inaccurate, incomplete, contextually mistaken, offensive, or misleading, particularly with idiom, slang, technical terminology, ambiguity, humour, sarcasm, or culturally specific expressions. MakZens provides all translated output on an "as is" and "as available" basis, makes no warranty as to the fidelity, accuracy, or fitness for any purpose of any translation, and you agree not to rely on automated translations for legal, medical, financial, safety-critical, or other consequential decisions without independent human verification.

You are solely responsible for the content you submit for translation and transmission, including that you hold all necessary rights to such content and that its translation and delivery do not violate any applicable law or the rights of any third party. JXMSN LLC does not author, endorse, or assume responsibility for the meaning conveyed by any original or machine-translated message, and any dispute arising from the interpretation of a translated message rests between the communicating users.

Automated AI processing within MakZens extends beyond textual translation and may include the transcription and translation of voice messages, the processing of media captions and shared content, and related language-detection operations. Where such features are used, the corresponding audio, transcript, or textual data is likewise transmitted to the applicable third-party AI or translation processors solely to deliver the requested feature, and the same limitations of warranty and reliance set out in these Terms apply equally to those outputs.

The third-party AI and translation providers engaged by MakZens operate under their own technical, security, and data-handling practices, and JXMSN LLC selects such providers with the aim of enabling automated translation rather than exercising control over their internal model behaviour. While JXMSN LLC endeavours to engage providers that process message content only for the purpose of performing the requested translation and not for independent model training on your identifiable content, JXMSN LLC does not warrant the internal operations of any such provider and disclaims liability for acts or omissions of these processors to the fullest extent permitted by law.

Because translation is performed by automated systems and third-party AI providers rather than by human agents, MakZens does not routinely monitor, read, or store the substantive content of your messages for editorial purposes, and translation is executed on a transient, functional basis. Where technically feasible, message payloads are handled ephemerally by the translation pipeline; however, you acknowledge that momentary processing, transmission, and caching by third-party processors is a necessary consequence of delivering real-time cross-language messaging.

For users in the European Union and European Economic Area, the processing of message content for translation constitutes personal data processing under the General Data Protection Regulation (Regulation (EU) 2016/679), and JXMSN LLC relies on the necessity of such processing for the performance of the messaging contract between you and MakZens and, where applicable, on your consent. Details of the categories of processors, international data transfers, retention, and the rights available to you, including access, rectification, erasure, restriction, and objection, are set out in the MakZens Privacy Policy, which forms an integral part of these Terms.

For users in the United Arab Emirates, processing is undertaken in accordance with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and its implementing regulations. You acknowledge that the automated translation function necessarily involves the transfer of message content across international borders to third-party translation processors that may be located outside the United Arab Emirates, and you consent to such cross-border transfers as required to provide the service, subject to the safeguards described in the Privacy Policy.

The transmission of message content to third-party AI translation providers may involve the transfer of personal data to jurisdictions outside your country of residence, including outside the EU/EEA and the UAE, where data-protection standards may differ. JXMSN LLC endeavours to implement appropriate safeguards for such transfers, including contractual protections with its processors where required by applicable law, and by using MakZens you consent to the international transfer of your message content strictly to the extent necessary to perform automated translation.

Contacts matching within MakZens is performed using a hashed representation of email addresses rather than plaintext contact data, so that the service may identify mutual contacts without exposing the underlying addresses. This matching function is distinct from the translation pipeline; contact identifiers are not submitted to the translation processors, and their use is governed by the data-minimisation principles described in the Privacy Policy.

Push notifications delivered by MakZens are designed to protect the confidentiality of your communications, and the push payload transmitted through third-party mobile operating-system push services carries only the sender identifier and a generic placeholder rather than the substantive or translated content of the message. The full message text is retrieved and, where applicable, translated only after the notification is opened within the application, so that message content is not disclosed to intermediary push infrastructure.

Optional MakZens premium plans, including one-time purchases and subscriptions, are paid in USDC stablecoin on the Solana or BSC networks and are processed exclusively by NowPayments, a third-party payment processor. JXMSN LLC does not custody cryptocurrency, does not operate a wallet, exchange, investment, or financial-advisory service, and the automated verification of a successful payment for the purpose of unlocking premium translation and messaging features is carried out on the basis of confirmation data received from NowPayments and the relevant blockchain, for which JXMSN LLC accepts no responsibility as to network availability, transaction finality, or exchange-rate movements.

As an alternative route to unlocking premium features, MakZens supports verification of a third-party "JokerX" NFT by means of a server-to-server check combined with a one-time confirmation code, and this process does not require you to connect any cryptocurrency wallet within the application. You acknowledge that JokerX and the associated NFT ecosystem are operated by third parties independent of JXMSN LLC, that the outcome of the verification depends on data provided by those third-party systems, and that JXMSN LLC makes no representation as to the value, availability, or continued support of any such NFT.

The MakZens referral programme permits partners to share a personal referral link, and any commissions arising from referrals are calculated and settled by the third-party JokerX system rather than by JXMSN LLC. Participation in the referral programme does not create any employment, agency, or partnership relationship with JXMSN LLC, and JXMSN LLC is not a party to, and accepts no liability for, the calculation, timing, or payment of commissions administered by JokerX.

You must not misuse the automated translation and AI processing functions of MakZens, including by submitting content designed to manipulate, overload, reverse-engineer, or extract the underlying models of the third-party translation providers, by attempting to circumvent usage limits or premium gating, or by transmitting unlawful, infringing, or prohibited material for translation. JXMSN LLC reserves the right to suspend, throttle, or terminate access to the translation features, or to the service as a whole, where such misuse is reasonably suspected, and to cooperate with its processors and competent authorities as required by law.

These Terms, including this section governing real-time translation and automated AI processing, are governed by and construed in accordance with the laws applicable in the Emirate of Dubai, United Arab Emirates, and you and JXMSN LLC (registered at PO Box 393394, Dubai, United Arab Emirates, [insert registration number]) submit to the jurisdiction of the competent courts of Dubai in respect of any dispute arising out of or in connection with the translation and AI-processing functions of MakZens. JXMSN LLC may amend this section from time to time to reflect changes in its translation processors, payment or verification providers, or applicable data-protection obligations, and continued use of the service following the effective date of any such amendment, notice of which may be provided at [insert notice address] or privacy@makzens.app, constitutes your acceptance of the revised terms.

The messaging functionality of MakZens enables you to exchange text messages, voice messages, photographs, files, and location information within one-to-one chats, group chats, and public or private channels. Because MakZens is a cross-language messenger, you acknowledge and agree that the textual content of your messages is transmitted to third-party artificial-intelligence and large-language-model providers acting as translation processors for the sole purpose of producing an automated real-time translation. Both the original text and the machine-generated translation may be stored, displayed, and delivered to recipients in order to operate the service. JXMSN LLC does not manually review the substance of your communications and does not guarantee the accuracy, completeness, or fitness for any purpose of any automated translation.

You accept that automated translation is inherently imperfect and that translated output may contain errors, omissions, mistranslations, altered tone, or loss of nuance, idiom, humour, legal meaning, or cultural context. You must not rely on any MakZens translation for medical, legal, financial, safety-critical, contractual, or other consequential decisions, and you remain solely responsible for verifying meaning through a qualified human translator where accuracy is material. To the fullest extent permitted under the laws of the Emirate of Dubai and the United Arab Emirates, JXMSN LLC excludes all liability for loss or damage arising from reliance on machine-translated content.

By sending any message, voice recording, photograph, file, or other content through MakZens, you represent and warrant that you hold all necessary rights to that content and grant JXMSN LLC a limited, non-exclusive, royalty-free licence to process, transmit, translate, cache, and deliver it as strictly necessary to operate the service and its translation, delivery, and multi-device synchronisation features. This licence exists only to make MakZens function and terminates when the content is deleted, subject to routine technical backups and the retention obligations described in the Privacy Policy. You retain ownership of your content at all times.

Voice messages, voice calls, and video calls are provided as convenience features and may depend on network conditions, device capabilities, and the availability of third-party infrastructure. You acknowledge that real-time voice and video communications are generally not subject to automated translation, that call quality is not warranted, and that MakZens must not be used as a substitute for any emergency, public-safety, or medical-alert service. JXMSN LLC does not guarantee uninterrupted or error-free voice or video functionality and accepts no liability for missed, dropped, or degraded calls.

When you create or administer a group chat or a channel, you assume responsibility for its membership, its stated purpose, and the conduct that you tolerate within it, and as an administrator you may add or remove participants, moderate content, and configure available settings. Public channels are, by their nature, accessible to a broad audience, and you must not treat any communication in a public channel as private or confidential. JXMSN LLC may, but is under no general obligation to, monitor group or channel activity, and it reserves the right to suspend or remove any group or channel that violates these Terms or applicable law.

MakZens offers optional message features including reactions, replies, editing of previously sent messages, and disappearing (self-destructing) messages, and you agree to use these features in good faith. You acknowledge that disappearing-message timers reduce visibility of content within the application but cannot technically prevent a recipient from capturing, screenshotting, forwarding, copying, or otherwise retaining a message before it disappears. Editing a message alters only the version presented within MakZens and does not recall copies already delivered, translated, cached by third-party translation providers, or observed by recipients.

The contacts-matching feature allows MakZens to identify which of your existing contacts also use the service by comparing hashed representations of email addresses rather than transmitting your address book in clear text. By enabling contacts matching you confirm that you are entitled to submit the relevant contact information for this limited matching purpose, in a manner consistent with the General Data Protection Regulation for users in the EU and EEA and with the United Arab Emirates Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data. You may disable contacts matching, and further detail on this processing is set out in the Privacy Policy.

MakZens sends push notifications to alert you to new messages, calls, and related events, and to preserve confidentiality the push payload transmitted through the relevant mobile push infrastructure carries only the identity of the sender together with a generic placeholder rather than the substance of any message. The full message text is retrieved and, where applicable, translated on your device only after the application is opened and authenticated. You acknowledge that delivery of push notifications depends on third-party operating-system and push-gateway services outside the control of JXMSN LLC and is therefore not guaranteed.

Message deep links allow a specific message, chat, or channel to be referenced by a shareable link, and multi-device access permits you to connect additional sessions, including a browser-based web client, by scanning a QR code from an already-authenticated device. You are solely responsible for safeguarding deep links and QR-code login flows, for authorising only trusted devices, and for terminating sessions you no longer use. Any person who obtains a valid deep link or completes a QR-code pairing may gain access to the associated content or account, and JXMSN LLC is not liable for unauthorised access resulting from your failure to protect these mechanisms.

You agree not to use the messaging, voice, call, group, or channel features to transmit content that is unlawful, defamatory, harassing, hateful, threatening, fraudulent, infringing, sexually exploitative of minors, or otherwise prohibited under the laws of the United Arab Emirates, including applicable cybercrime and content legislation, or under other laws applicable to you. You further agree not to distribute malware, engage in spam or bulk unsolicited messaging, impersonate others, or attempt to circumvent, overload, or interfere with the service or its translation, delivery, or security systems. Violation of this clause may result in immediate suspension or termination and, where required, disclosure to competent authorities.

You acknowledge that the substance of your communications is intelligible to the third-party translation processors that perform cross-language translation and to the extent it is stored to operate the service, and you therefore accept that MakZens does not provide end-to-end encryption of message content in the manner of services that never expose plaintext to their operator or processors. JXMSN LLC applies technical and organisational measures intended to protect content in transit and at rest, but no method of electronic transmission or storage is completely secure. You should exercise appropriate discretion regarding the sensitivity of information you choose to communicate through the service.

Access to MakZens is provided through an Android application distributed as a direct APK download from the MakZens website, an installable progressive web application for iPhone and iPad, and a browser-based web client, and it is expressly not distributed through the Apple App Store or Google Play for this direct-download path. You are responsible for obtaining the application only from official MakZens sources, for enabling any device settings required to install a directly downloaded APK, and for keeping the application updated. JXMSN LLC disclaims responsibility for any harm arising from installation of modified, repackaged, or unofficial builds obtained from third-party sources.

Certain messaging and platform capabilities may be reserved for optional premium plans, offered as either a one-time purchase or a recurring subscription, and priced and described at the point of purchase. Premium payments are made in USDC stablecoin on the Solana or BSC networks and are processed exclusively by the third-party payment processor NowPayments, whose own terms and privacy practices govern that transaction. JXMSN LLC does not custody cryptocurrency and provides no wallet, exchange, custody, investment, brokerage, or financial-advisory service; you bear sole responsibility for your wallet, private keys, network selection, and any blockchain transaction fees or irreversible transfer errors.

As an alternative to payment, premium features may be unlocked by verifying ownership of a qualifying third-party JokerX non-fungible token through a server-to-server verification combined with a one-time confirmation code, without any wallet connection being made within the MakZens application. You acknowledge that JokerX and the associated NFT are operated by an independent third party over which JXMSN LLC exercises no control, and that the availability, value, and continued recognition of any such NFT-based entitlement depend on that third party. Failure of, or changes to, the JokerX verification system may affect your access to premium features, and JXMSN LLC accepts no liability for such third-party changes.

MakZens operates an optional referral programme under which participating partners share a personal referral link, and any resulting commissions are calculated and settled by the third-party JokerX system rather than by JXMSN LLC directly. Your participation is subject to any separate programme rules, and you must not promote the service through spam, deception, misrepresentation, or unlawful means, nor generate referrals through fraudulent, automated, or self-dealing activity. JXMSN LLC may suspend referral entitlements arising from abuse and is not liable for the acts, omissions, calculations, or payment decisions of the JokerX settlement system.

The service, including its messaging, translation, voice, call, group, and channel features, is provided on an "as is" and "as available" basis, and JXMSN LLC does not warrant that it will be uninterrupted, timely, secure, or free of errors, nor that translations, notifications, or deliveries will be accurate or complete. To the maximum extent permitted by the laws of the Emirate of Dubai and the United Arab Emirates, all implied warranties are disclaimed, and the aggregate liability of JXMSN LLC arising out of or in connection with the service shall not exceed the amount you paid, if any, for premium features in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

These Terms, and any dispute arising out of or in connection with the messaging, voice, call, group, or channel features of MakZens, are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and are subject to the exclusive jurisdiction of the competent courts of Dubai. Processing of personal data is conducted in accordance with the General Data Protection Regulation for users in the EU and EEA and the United Arab Emirates Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, as further described in the Privacy Policy. JXMSN LLC, a company registered at PO Box 393394, Dubai, United Arab Emirates [insert registration number], may be contacted regarding these Terms at [insert contact email], and privacy enquiries may be directed to privacy@makzens.app.

Scope of Premium Offerings. MakZens provides certain optional paid features ("Premium Plans") in addition to its free real-time cross-language messaging service operated by JXMSN LLC, PO Box 393394, Dubai, United Arab Emirates. Premium Plans are made available either as a one-time purchase granting a defined set of features for a stated duration or without expiry as specified at the point of sale, or as a recurring subscription that renews on a periodic basis. The specific entitlements, feature set, term and price of each Premium Plan are those displayed to you within the application or on the MakZens website at the time you place your order, and those displayed particulars prevail over any general description in these Terms.

Payment Processor and Accepted Means of Payment. Payments for Premium Plans are denominated and settled in the USDC stablecoin on the Solana or BSC (BNB Smart Chain) networks and are processed exclusively by NowPayments, an independent third-party payment processor, and not by JXMSN LLC. By initiating a purchase you authorise the transmission of the transaction data necessary to complete payment to NowPayments and agree that your use of that service is additionally governed by NowPayments' own terms and privacy notice. JXMSN LLC does not receive or store your wallet credentials or private keys and is not responsible for the availability, accuracy or performance of the NowPayments service or of the underlying blockchain networks.

No Crypto Custody or Financial Services. MakZens accepts USDC solely as a means of payment for Premium Plans and neither custodies cryptoassets on your behalf nor provides any wallet, exchange, brokerage, staking, investment, or financial-advisory service. You are exclusively responsible for the funding, security and correct operation of the external wallet from which you pay, including selection of the correct network and recipient address. JXMSN LLC gives no advice on, and accepts no liability for, the volatility, tax treatment, or regulatory status of USDC or any other digital asset used in connection with a purchase.

Confirmation of On-Chain Payments and Network Risk. Because payments settle on public blockchains, a purchase is treated as completed only once the corresponding USDC transaction has been confirmed by the relevant network and reported as successful by NowPayments. You acknowledge that on-chain transfers are generally irreversible, that network confirmation times and transaction fees are outside the control of JXMSN LLC, and that payments sent to an incorrect address, on the wrong network, or in an incorrect amount may be unrecoverable. Where a payment is underpaid, overpaid, or delayed, the outcome (including any refund, credit, or requirement to top up) shall be determined by the reconciliation reported by NowPayments.

JokerX NFT Alternative Unlock. As an alternative to paying in USDC, eligible users may unlock Premium features by verifying ownership of a qualifying third-party "JokerX" NFT through a server-to-server check combined with a one-time confirmation code, without connecting any wallet to the MakZens application. Entitlement granted by this method is conditional on the verification returning a positive result and may be suspended or revoked if a subsequent check indicates that the qualifying NFT is no longer validly held. JXMSN LLC does not issue, endorse, value, or guarantee the JokerX NFT or the JokerX system, and any dispute concerning ownership, transfer, or authenticity of the NFT lies between you and the relevant third-party issuer or platform.

Referral Programme and Commission Settlement. Where you participate in the MakZens referral programme, you may share a personal referral link, and any commissions arising from qualifying referrals are calculated and settled by the third-party JokerX system rather than by JXMSN LLC directly. JXMSN LLC does not guarantee any particular level of referral earnings, and the eligibility criteria, commission rates, and payout timing are those defined by the JokerX referral rules as amended from time to time. You agree to promote MakZens only in a lawful, truthful, and non-spam manner, and JXMSN LLC may disqualify referrals obtained through fraud, self-referral, or misrepresentation.

Grant and Nature of the Premium Licence. Purchase of a Premium Plan grants you a personal, non-exclusive, non-transferable, revocable licence to use the specified Premium features for the applicable term, and confers no ownership interest in the software or service. Premium entitlements are tied to your MakZens account and, unless expressly stated at the point of sale, may not be resold, sublicensed, shared, or transferred to another user or account. Premium features remain subject to these Terms and to the general acceptable-use rules governing the MakZens service.

Feature Availability Across Distribution Channels. MakZens is distributed as a direct APK download for Android, as an installable progressive web application (PWA) for iPhone and iPad, and as a browser-based web client, and it is not distributed through the Apple App Store or Google Play for the direct-download path. Consequently, Premium Plans are billed solely through the mechanisms described in these Terms and not through any app-store billing system, and no app-store purchase, subscription, or refund policy applies to them. Certain Premium features may depend on device or platform capabilities, and where a feature is unavailable on a given platform this does not by itself entitle you to a refund provided the feature remains available on at least one supported platform.

Subscription Term and Automatic Renewal. Subscription Premium Plans renew automatically at the end of each subscription period for a further period of equal length, at the price and on the terms then in effect, until cancelled in accordance with these Terms. Because settlement occurs in USDC via NowPayments and MakZens does not hold a stored payment credential, renewal requires the completion of a further USDC payment or a valid JokerX unlock for the ensuing period, and Premium access will lapse if the applicable renewal payment or verification is not completed before the current period ends. You will be shown the renewal price and period before each renewing purchase is finalised.

Cancellation and Effect of Cancellation. You may cancel a subscription at any time through the account settings in the application or by contacting [billing@makzens.app], and cancellation stops any further renewal charges for periods that have not yet commenced. Cancellation does not retroactively reverse a payment already completed for the current period, and unless a mandatory statutory right applies you will retain access to the Premium features until the end of the period for which you have already paid. One-time purchases, by their nature, are not "cancelled" but simply expire at the end of their stated duration, if any.

Price Changes. JXMSN LLC may change the price of any Premium Plan, introduce new plans, or discontinue existing plans at its discretion, and any price change will apply to one-time purchases made, and to subscription periods commencing, after the change takes effect. For subscriptions, the price applicable to a given renewal is the price displayed to you before you complete the USDC payment or JokerX unlock for that renewal, so that no renewal is charged at an increased price without the amount being shown to you beforehand. Price changes will never retroactively affect a period for which payment has already been confirmed.

Statutory Withdrawal Rights and Immediate Performance. Where you are a consumer entitled to a statutory right of withdrawal, including under applicable European Union and European Economic Area consumer law, that right applies to the extent it is mandatory and cannot be excluded. By purchasing a Premium Plan that provides immediate access to digital features, you expressly request that performance begin immediately and acknowledge that, once the Premium features have been fully supplied at your request, any such withdrawal right may be lost to the extent permitted by law. Nothing in this clause limits any non-waivable consumer protection to which you are entitled in your jurisdiction of residence.

Refunds. Except where a refund is required by mandatory applicable law or is expressly offered by JXMSN LLC in a particular case, all payments for Premium Plans are final and non-refundable, reflecting the immediate digital nature of the features and the irreversible, on-chain manner of settlement. Where a refund is granted, it will be processed through NowPayments in USDC to a wallet address you nominate, and JXMSN LLC is not responsible for network fees, exchange-rate movements, or value differences between the time of payment and the time of any refund. Requests for a refund on grounds of a mandatory legal right should be submitted to [billing@makzens.app] with the relevant transaction details.

Continued Reliance on Third-Party Translation Within Premium Features. Premium Plans do not alter the fundamental operation of MakZens whereby messages are translated in real time through third-party artificial-intelligence and large-language-model providers acting as translation processors, and both original and translated text continue to be handled for that purpose. Purchasing a Premium Plan does not guarantee the accuracy, completeness, tone, or fitness for any particular purpose of any translation, whether of chat messages, group or channel content, or other translated material, and translation quality may vary by language pair and provider. You should not rely on automated translation for legal, medical, financial, or other high-stakes communications, and this limitation applies equally to free and Premium use.

Suspension, Downgrade, and Termination for Breach. JXMSN LLC may suspend, downgrade, or terminate Premium entitlements, without refund of amounts already paid, where you materially breach these Terms, engage in fraud or abuse in connection with payments, the JokerX unlock, or the referral programme, or where continued provision would violate applicable law or sanctions. Where a chargeback, payment reversal, or invalidated JokerX verification indicates that consideration for a Premium Plan was not validly provided, JXMSN LLC may revoke the corresponding Premium features. Wherever reasonably practicable and lawful, JXMSN LLC will give notice before taking such action and will limit the measure to what is proportionate to the breach.

Data Protection in Connection with Purchases. Personal data processed in connection with Premium Plans is handled in accordance with the MakZens Privacy Policy and applicable data-protection law, including the EU/EEA General Data Protection Regulation (GDPR) and the United Arab Emirates Personal Data Protection Law (Federal Decree-Law No. 45 of 2021). Payment is processed by NowPayments as an independent controller or processor for the payment transaction, JokerX processes data for the NFT unlock and referral settlement, and features such as contacts matching by hashed email and push notifications continue to operate as described in the Privacy Policy; JXMSN LLC does not itself receive or retain your wallet private keys. Questions regarding the processing of your data may be directed to [privacy@makzens.app].

Governing Law, Jurisdiction, and Severability of this Section. This section on Premium Plans, one-time purchases, and subscriptions is governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and the courts of Dubai shall have jurisdiction over disputes arising from it, in each case without prejudice to any mandatory consumer-protection or data-protection rights available to you under the law of your habitual residence. If any provision of this section is held invalid or unenforceable, the remaining provisions shall continue in full force, and the invalid provision shall be replaced by a valid provision that most closely reflects its original commercial and legal intent. In the event of conflict between this section and the general provisions of these Terms, this section prevails with respect to Premium Plans.

MakZens offers optional premium plans, comprising both one-time purchases and recurring subscriptions, which unlock designated paid features of the messenger while all core cross-language messaging functions remain available under the applicable free tier. The specific scope, duration and feature set of each plan are those displayed within the MakZens application or on the MakZens website at the time of purchase, and JXMSN LLC reserves the right to modify plan compositions prospectively. Your access to premium features is contingent upon the successful confirmation of payment in accordance with the clauses set out below.

All premium payments are denominated and settled exclusively in the USDC stablecoin, payable on either the Solana network or the BNB Smart Chain (BSC), as selected by you at checkout. You are solely responsible for selecting the correct network, for ensuring that the transaction is sent to the address generated for your order, and for bearing all network, gas and miner fees associated with the transfer. JXMSN LLC does not accept payment in fiat currency, in any token other than USDC, or on any blockchain network other than those expressly offered at the point of sale.

Payment processing is performed exclusively by NowPayments, an independent third-party payment processor, and not by JXMSN LLC. When you elect to purchase a premium plan you are directed to a payment flow operated by NowPayments, and your submission of a crypto payment constitutes acceptance of the NowPayments terms and privacy practices in addition to these Terms. JXMSN LLC does not control the availability, timing, exchange-rate handling, confirmation logic or fee schedule of NowPayments, and any dispute concerning the mechanics of a transfer must be resolved having regard to the role of that processor.

You expressly acknowledge that JXMSN LLC does not custody, hold, store, transmit or manage cryptocurrency on your behalf, and that MakZens is a messaging service and not a wallet, exchange, custodian, broker, money-services business, investment vehicle or financial adviser. No part of the MakZens service should be construed as the provision of financial, investment, tax or legal advice, and the operator provides no wallet software and never takes possession of your private keys. You are the sole controller of the wallet from which you pay and you bear all risk arising from your use of it.

You bear full and exclusive responsibility for the accuracy of every payment you initiate, including the recipient address, the selected network, the transferred amount and the timeliness of confirmation. Because settlement occurs on a public blockchain, cryptocurrency transactions are irreversible, and JXMSN LLC cannot reverse, recall, cancel or refund a transfer once it has been broadcast. Payments sent to an incorrect address, on an unsupported network, in an incorrect amount, or after the expiry of a payment window may be irretrievably lost, and JXMSN LLC accepts no liability for such loss.

Where a payment is underpaid, overpaid, delivered after the applicable payment window has expired, or received on a network different from the one designated for the order, the transaction may fail to unlock premium features automatically and may require manual review. In such cases JXMSN LLC will make reasonable efforts to reconcile the payment against confirmations reported by NowPayments and the relevant blockchain, but reserves the right to credit the corresponding plan, to request a supplementary payment for any shortfall, or to decline activation where the discrepancy cannot be reconciled. Any refund of an overpaid or misdirected amount, where technically feasible, will be made in USDC to a wallet address you verifiably control.

You acknowledge that USDC is a stablecoin whose value is intended to track the United States dollar but is not guaranteed to do so, and that its market value, redeemability and network availability lie entirely outside the control of JXMSN LLC. The pricing of premium plans may be expressed as a USDC amount or as a fiat-referenced amount converted to USDC at the rate applied by NowPayments at the moment of checkout, and you accept that rate as final for the transaction. JXMSN LLC is not responsible for any loss you incur as a result of fluctuations in the value of USDC or the network tokens used to pay transaction fees.

For recurring subscriptions settled in USDC, you authorise the generation of a new payment request for each billing cycle and remain responsible for completing the corresponding transfer on time to maintain uninterrupted access. Because on-chain payments are not collected by automatic charge in the manner of a card mandate, a subscription will not renew unless the required USDC payment for the ensuing period is received and confirmed; failure to pay by the renewal date will result in downgrade to the free tier without further notice. You may decline to renew simply by not submitting the next cycle's payment, and any partial period already paid for remains valid until its natural expiry.

Except where a mandatory right of withdrawal or refund applies under the law of the European Union or the European Economic Area, or under other non-excludable consumer-protection law, all premium purchases are final and non-refundable once the associated premium features have been made available to you. Where an EU or EEA consumer exercises a statutory right of withdrawal, you acknowledge that by requesting immediate access to a digital service you may forfeit that right to the extent permitted under the applicable implementation of the Consumer Rights Directive. Any refund lawfully due will be issued in USDC to a wallet address you control, net of irrecoverable network fees.

As an alternative to payment via NowPayments, premium access may be unlocked through verification of a qualifying third-party JokerX NFT by means of a server-to-server check combined with a one-time confirmation code. This mechanism does not require you to connect a wallet to the MakZens application and does not transfer custody of, or grant JXMSN LLC any interest in, the NFT; it verifies eligibility only. JXMSN LLC does not issue, endorse, value or guarantee any JokerX NFT, disclaims all responsibility for the JokerX system and its availability, and reserves the right to revoke premium access where a confirmation code is found to be invalid, reused, revoked or fraudulently obtained.

The MakZens referral programme permits participating partners to share a personal referral link, with any commissions calculated, attributed and settled entirely by the third-party JokerX system and not by JXMSN LLC. JXMSN LLC does not guarantee the accuracy, timing or payment of any referral commission, makes no representation as to the terms on which JokerX operates, and is not a party to the settlement of amounts owed between JokerX and any partner. Participation in the referral programme is subject to any additional programme rules published by JXMSN LLC or JokerX, and abusive, self-referring or fraudulent activity may result in forfeiture of commissions and termination of participation.

You are solely responsible for determining, reporting and discharging any taxes, levies or duties arising from your purchase of premium plans, your receipt of referral commissions, or your dealings in USDC and NFTs, in each of your applicable jurisdictions. Prices displayed for premium plans are exclusive of any such taxes unless expressly stated otherwise, and JXMSN LLC does not act as your tax agent or adviser. Where JXMSN LLC is required by law to collect or remit any tax in respect of a transaction, it may do so and adjust the amount payable accordingly.

Access to and payment for premium features is available irrespective of whether you use MakZens as a direct Android APK download, as an installable web application (PWA) on iPhone or iPad, or through the browser-based web client, and payment obligations are identical across these distribution channels. You acknowledge that the APK and PWA distribution paths are provided independently of the Apple App Store and Google Play, that in-application store billing mechanisms therefore do not apply, and that all premium billing is conducted solely through the crypto payment flow described in these Terms. Availability of the MakZens payment flow in a given territory may be constrained by the operational and compliance requirements of NowPayments.

You represent and warrant that you are not located in, ordinarily resident in, or acting on behalf of any person in a jurisdiction that is subject to comprehensive sanctions, and that you are not a person with whom transactions are prohibited under the sanctions laws applicable to JXMSN LLC or to NowPayments. You further undertake that funds used to purchase premium plans are of lawful origin and are not the proceeds of any criminal or fraudulent activity. JXMSN LLC and NowPayments may decline, suspend, freeze or reverse a transaction, and may withhold or revoke premium access, where required to comply with applicable anti-money-laundering, counter-terrorist-financing or sanctions obligations.

JXMSN LLC will make available, through the MakZens application or upon request, a basic confirmation of premium purchases sufficient to evidence the plan acquired and the date of activation; a formal tax invoice can be requested at [insert billing contact email]. Because payments are settled on-chain via NowPayments, the authoritative record of a payment is the corresponding blockchain transaction together with the confirmation reported by NowPayments, and you should retain your transaction hash. You agree to keep your contact details current so that billing-related communications can reach you, noting that MakZens matches contacts by hashed email and that your account email is used for such notices.

Any billing dispute, including an allegation of non-delivery of premium features following a confirmed payment, must be raised with JXMSN LLC at [insert billing contact email] within thirty (30) days of the transaction, accompanied by the relevant transaction hash and order reference. JXMSN LLC will investigate in good faith and may, at its discretion and where the payment is verifiably confirmed on-chain, credit the plan, extend the subscription period, or issue a USDC refund; it is under no obligation to compensate for losses attributable to your own payment error or to third-party network conditions. Initiating a dispute does not suspend your other obligations under these Terms.

The payment, cryptocurrency and billing arrangements described in this section are governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and are subject to the exclusive jurisdiction of the competent courts of Dubai, without prejudice to any mandatory consumer-protection rights available to you under the General Data Protection Regulation, other EU or EEA law, or, in the case of UAE residents, the Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data. To the maximum extent permitted by applicable law, the aggregate liability of JXMSN LLC arising out of or in connection with any premium purchase shall not exceed the amount actually paid by you for the premium plan giving rise to the claim. Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited.

The MakZens referral programme permits eligible users ("Partners") to share a personal referral link generated within the MakZens application, which is operated by JXMSN LLC (PO Box 393394, Dubai, United Arab Emirates) (the "Operator"). Participation in the programme is voluntary, is offered at the Operator's sole discretion, and does not form part of the core messaging service. Nothing in these terms obliges the Operator to maintain, continue, or offer the referral programme, and the Operator may modify, suspend, or terminate the programme in whole or in part at any time in accordance with the clauses set out below.

Commissions arising from valid referrals are calculated, recorded, and settled exclusively through the third-party "JokerX" system, which operates independently of the MakZens application. The Operator does not itself custody, hold, calculate, or disburse Partner commissions, and its role is limited to generating referral links and transmitting the associated referral attribution data to the JokerX system. Partners acknowledge that entitlement to, and payment of, any commission is governed by the terms, eligibility rules, and settlement schedules of the JokerX system, and that any dispute concerning commission amounts or payment must be pursued in accordance with those third-party arrangements.

A referral is deemed valid only where a new user registers for MakZens through a Partner's unique referral link and satisfies the qualifying conditions defined by the JokerX system at the relevant time, which may include completion of registration, activation of a premium plan, or other measurable events. The Operator makes no representation that any particular click, download of the Android APK, installation of the iPhone or iPad web application (PWA), or use of the browser web client will result in a qualifying referral. Referrals that cannot be attributed through the technical mechanisms available to the Operator and the JokerX system shall not give rise to any commission.

Referral attribution relies on the correct propagation of referral parameters through the MakZens distribution channels, including the direct Android APK download from the Operator's website, the installable PWA, and the browser-based web client. Because MakZens is not distributed through the Apple App Store or Google Play for the direct-download path, attribution mechanisms customary to those stores do not apply, and Partners acknowledge that link tracking may be affected by browser settings, cookie restrictions, private-browsing modes, ad-blocking software, or a referred user's device configuration. The Operator shall not be liable for referrals that fail to register due to such factors beyond its reasonable control.

Commission rates, tiers, thresholds, minimum-payout amounts, and any hold or clawback periods are determined and published by the JokerX system and not by the Operator. The Operator does not warrant any particular commission rate or level of earnings, and any figures presented within the MakZens interface for indicative purposes are provided without guarantee. Where a conflict arises between figures displayed in MakZens and the records maintained by the JokerX system, the records of the JokerX system shall prevail for the purpose of commission settlement.

Where commissions relate to premium plans purchased by referred users, Partners acknowledge that such purchases are processed by the third-party payment processor NowPayments and are settled in USDC stablecoin on the Solana or BSC networks. The Operator does not custody cryptocurrency, does not operate a wallet, exchange, investment, or financial-advisory service, and does not convert, hold, or transmit crypto-assets on behalf of Partners. Any commission that is itself paid in crypto-assets is administered by the JokerX system, and the Partner is solely responsible for maintaining a valid receiving address and for the security of any wallet used to receive such amounts.

Commissions may also arise in connection with premium access unlocked through verification of a third-party "JokerX" NFT, which is confirmed by a server-to-server check together with a one-time confirmation code and does not require any wallet connection within the MakZens application. Partners acknowledge that eligibility, verification, and any resulting commission for NFT-based unlocks are governed by the JokerX system and are subject to the successful completion of the applicable verification steps. The Operator does not verify ownership of, value, or authenticity of any NFT beyond the technical server-to-server check it performs, and gives no assurance as to the availability or continuation of the NFT-unlock pathway.

Partners shall promote MakZens only in a lawful, accurate, and non-misleading manner and shall not make any representation concerning the application, its real-time translation functionality, its features, or its premium plans that is untrue, exaggerated, or not expressly authorised by the Operator. In particular, Partners shall not describe MakZens as offering financial, investment, exchange, or custody services, nor represent that message translation performed by third-party artificial-intelligence or large-language-model providers is guaranteed to be accurate, complete, or error-free. The Operator may require the immediate correction or removal of any promotional material that breaches this clause.

Partners shall not engage in any form of spam, unsolicited bulk messaging, deceptive advertising, cookie stuffing, self-referral, the creation of fraudulent or duplicate accounts, or the manipulation of the contacts-matching mechanism (which operates on hashed email addresses) for the purpose of generating illegitimate referrals. The Operator and the JokerX system reserve the right to withhold, reverse, or cancel any commission that is reasonably suspected to have arisen from such conduct. Repeated or serious breaches may result in immediate termination of the Partner's participation and forfeiture of accrued but unpaid commissions.

Partners shall not use MakZens features such as one-to-one chats, group chats, public or private channels, message deep links, or push notifications to distribute referral links in a manner that constitutes unsolicited commercial communication or that otherwise breaches applicable anti-spam, consumer-protection, or electronic-communications laws. Where a Partner sends referral communications by email or messaging, the Partner is responsible for obtaining any consent required under applicable law and for honouring opt-out requests. The Operator may restrict or disable a Partner's ability to distribute referral links through in-application channels where misuse is detected.

In operating the referral programme, the Operator processes limited personal data, including referral link identifiers, attribution events, and, where applicable, the hashed email addresses used for contacts matching, in accordance with its Privacy Policy and applicable data-protection law. Such processing is carried out in compliance with Regulation (EU) 2016/679 (the General Data Protection Regulation) for Partners and referred users in the EU/EEA and with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). Partners who collect or process personal data of prospective referred users in the course of their promotional activity act as independent controllers in respect of that data and shall comply with all obligations applicable to them under the GDPR, the PDPL, and any other applicable law.

Partners acknowledge that the settlement of commissions through the JokerX system and, where relevant, the processing of underlying premium payments through NowPayments necessarily involve the transfer of certain identifying or transactional data to those third parties. Such transfers are limited to the data necessary to attribute referrals and effect settlement, and the Operator does not transmit the content of users' messages, translated text, or voice, video, file, or location data to the referral or payment systems. Partners consent to the transfer of their referral and settlement data to the JokerX system for the purpose of administering their commissions.

The Operator does not guarantee any minimum volume of referrals, any minimum earnings, or the continued availability of the MakZens application, its features, or its third-party translation, payment, or referral processors. Any projections, examples, or illustrative earnings figures are provided for information only and do not constitute a representation or warranty of future results. Partners participate in the programme at their own commercial risk and shall not rely on referral commissions as a guaranteed source of income.

Partners are solely responsible for the declaration and payment of any taxes, duties, levies, or social contributions arising from commissions received through the JokerX system, including any tax consequences of receiving amounts denominated in USDC or other crypto-assets. The Operator does not provide tax, legal, accounting, or financial advice, and Partners should obtain independent professional advice regarding their individual circumstances. Where the Operator or the JokerX system is required by law to withhold amounts or to report payments to a competent authority, the Partner shall provide any information reasonably requested to enable compliance.

The Operator may suspend, adjust, reverse, or withhold commissions where a referred user's premium purchase is refunded, charged back, reversed, or cancelled, where a payment made through NowPayments fails to confirm on the relevant Solana or BSC network, or where an NFT-based unlock is subsequently found to be invalid. Commissions are provisional until the underlying qualifying event is confirmed as final and non-reversible in accordance with the rules of the JokerX system. The Operator shall not be liable for the reversal of any commission attributable to such events.

The Operator may vary the terms of the referral programme, including commission structures, eligibility criteria, and permitted promotional methods, by providing notice through the MakZens application or by email to the address associated with the Partner's account or to [insert Partner contact address]. Continued participation in the programme following the effective date of any such change constitutes acceptance of the amended terms. A Partner who does not accept a change may cease participation, in which case commissions accrued and confirmed as final prior to cessation shall be settled in accordance with the ordinary rules of the JokerX system. Questions regarding the programme or these terms may be directed to [insert contact email, e.g. partners@makzens.app].

This section, and any non-contractual obligations arising out of or in connection with the referral programme, shall be governed by and construed in accordance with the laws of Dubai, United Arab Emirates, and any dispute shall be subject to the exclusive jurisdiction of the competent courts of Dubai, without prejudice to any mandatory consumer-protection or data-protection rights that a Partner or referred user may enjoy under the GDPR, the UAE PDPL, or the law of their place of habitual residence. The relationship between the Operator and a Partner under this programme is that of independent parties, and nothing herein creates any employment, agency, partnership, joint venture, or franchise relationship. If any provision of this section is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

For the purposes of this section, "JokerX" means the third-party digital asset and verification system operated independently of JXMSN LLC, and "JokerX NFT" means a non-fungible token issued or recognised by that system which may, upon successful verification, unlock the optional premium features of MakZens. Verification of a JokerX NFT constitutes an alternative route to obtaining premium access instead of a one-time purchase or subscription paid in USDC stablecoin through the third-party payment processor NowPayments. The availability of this route does not alter the scope of the premium features themselves, which remain identical regardless of the unlock method chosen.

JokerX is a separate service provided by a third party and is neither owned, operated, controlled, endorsed nor guaranteed by JXMSN LLC. Your acquisition, holding, use and disposal of any JokerX NFT are governed exclusively by the terms, policies and smart-contract conditions of the JokerX system and its issuer, and not by these Terms and Conditions. JXMSN LLC is not a party to, and assumes no responsibility for, any transaction, representation or obligation arising between you and JokerX or any marketplace on which a JokerX NFT is acquired.

Verification of a JokerX NFT within MakZens is performed by a server-to-server check between our systems and the JokerX system, followed by your entry of a one-time confirmation code. At no point does MakZens request, require or facilitate the connection of a cryptocurrency wallet, and the application never accesses, stores or processes your private keys, seed phrases or wallet credentials of any kind. The verification confirms only that the account presenting the confirmation code is associated with a recognised JokerX NFT for the purpose of granting premium access.

The one-time confirmation code is personal to the MakZens account for which premium access is requested, is intended for a single successful redemption, and must not be sold, shared, published or transferred to any other person. JXMSN LLC may decline to honour, may invalidate, or may revoke access granted through a confirmation code that appears to have been duplicated, intercepted, generated fraudulently, or obtained in breach of the JokerX system's own rules. You are solely responsible for keeping any confirmation code confidential until it has been redeemed.

JXMSN LLC does not custody, hold, mint, transfer, value, buy, sell or trade any JokerX NFT or any cryptocurrency, and provides no wallet, exchange, brokerage, custody, investment or financial-advisory service in connection with NFT-based access. The NFT-based unlock is solely a technical mechanism for authenticating an existing entitlement and confers no rights over any digital asset held by you. Consistent with our USDC/NowPayments arrangements, MakZens remains a non-custodial participant that never takes possession of your crypto assets.

Eligibility for NFT-based premium access requires that a valid and recognised JokerX NFT be associated with your identity at the time the server-to-server verification is completed. JXMSN LLC makes no representation that any particular JokerX NFT is, or will remain, eligible, and reserves the right to rely conclusively on the eligibility signal returned by the JokerX system. If the JokerX system reports that no eligible NFT is associated with your request, premium access will not be granted through this route.

Nothing in this section constitutes financial, investment, legal or tax advice, and JXMSN LLC makes no representation or warranty as to the present or future value, liquidity, authenticity or transferability of any JokerX NFT. The value of digital assets may fluctuate significantly or fall to zero, and you acquire, hold and rely upon any JokerX NFT entirely at your own risk. Premium access to MakZens is a licence to use software features and must not be understood as an investment return, yield or financial benefit derived from the NFT.

Where you participate in the referral programme, you acknowledge that partner links are personal and that any commissions arising from referred activity are calculated, administered and settled by the third-party JokerX system rather than by JXMSN LLC. JXMSN LLC does not guarantee the accuracy, timing or payment of any referral commission and is not responsible for disputes concerning amounts, eligibility or settlement between you and JokerX. Your participation in the referral programme is additionally subject to the JokerX system's own referral terms.

To perform NFT-based verification, MakZens transmits to and receives from the JokerX system a limited set of data necessary for the check, which may include your MakZens account identifier, the confirmation code and the verification result. This processing is carried out in accordance with our Privacy Policy and with applicable data-protection law, including the EU/EEA General Data Protection Regulation (GDPR) and the United Arab Emirates Personal Data Protection Law (Federal Decree-Law No. 45 of 2021). You may exercise your data-subject rights by contacting privacy@makzens.app, subject to the limitation that data held within the JokerX system itself is controlled by that third party.

Premium access granted following a successful NFT verification is tied to the entitlement recognised at the moment of verification and does not create any continuing obligation on JXMSN LLC to monitor the subsequent status of the underlying JokerX NFT. If you sell, transfer, burn or otherwise dispose of the NFT after verification, JXMSN LLC reserves the right, but assumes no obligation, to re-verify eligibility and to suspend or withdraw premium access where continued eligibility can no longer be confirmed. Any re-verification will follow the same server-to-server, no-wallet-connection process described above.

The JokerX NFT and any rights attaching to it are governed by the separate terms, licences and smart-contract logic of the JokerX system, and those terms take precedence over these Terms and Conditions in respect of the NFT itself. You are responsible for reading, understanding and complying with the JokerX system's terms before acquiring or relying upon a JokerX NFT for MakZens access. In the event of a conflict between the JokerX terms and these Terms and Conditions, the latter continue to govern only your use of the MakZens application and its features.

JXMSN LLC does not warrant that the JokerX integration, the server-to-server verification endpoint or the confirmation-code mechanism will be available, uninterrupted, timely or error-free. The integration depends on the continued operation and cooperation of the third-party JokerX system, over which JXMSN LLC has no control, and verification may fail or be delayed for reasons attributable to that system. Where verification cannot be completed, you may instead obtain premium access by purchasing a one-time plan or subscription in USDC via NowPayments.

JXMSN LLC may, at its sole discretion and without liability, modify, suspend, restrict or discontinue the NFT-based access route, in whole or in part, including where the JokerX system ceases operation, changes its interfaces, or no longer meets our security, compliance or data-protection requirements. Where reasonably practicable, we will provide advance notice of any material discontinuation to affected users. Discontinuation of the NFT route does not by itself terminate premium access already validly granted, save where continued provision is unlawful or technically impossible.

You must not attempt to obtain premium access through forged, replayed, tampered or fraudulently generated verification data, nor circumvent, probe or interfere with the server-to-server check or confirmation-code process. JXMSN LLC may immediately suspend or terminate access, invalidate affected confirmation codes, and take further action where it reasonably suspects abuse, fraud or breach of this section or of the JokerX system's rules. Such measures are without prejudice to any other rights or remedies available to JXMSN LLC under these Terms and Conditions or applicable law.

Because verification is conducted without any wallet connection, JXMSN LLC never has, and never seeks, the technical ability to move, spend, freeze or otherwise dispose of your JokerX NFT or any associated assets. Any loss of, theft of, or unauthorised access to your NFT, wallet or JokerX account is a matter between you and the relevant third parties, and JXMSN LLC bears no responsibility for such events. You remain solely responsible for the security of your own digital-asset holdings and credentials at all times.

To the maximum extent permitted by applicable law, JXMSN LLC shall not be liable for any loss, damage, cost or claim arising from the acts, omissions, downtime, security failures, valuation changes or discontinuation of the JokerX system, the referral settlement process, or any NFT marketplace. The premium features unlocked through NFT verification, including real-time message translation performed by third-party AI and LLM translation providers, are provided on the same basis and subject to the same limitations as apply to premium access obtained by any other method. This limitation applies regardless of the unlock route and is in addition to the general limitations of liability set out elsewhere in these Terms and Conditions.

This section is governed by and construed in accordance with the laws of Dubai, United Arab Emirates, and any dispute arising out of or in connection with NFT-based access shall be subject to the jurisdiction identified in the general provisions of these Terms and Conditions. The distribution model of MakZens, namely direct APK download for Android and an installable web application (PWA) for iPhone and iPad outside the Apple App Store and Google Play, does not create any additional third-party rights or obligations in respect of the JokerX route. Where any provision of this section is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

All intellectual property rights in and to the MakZens application, the browser web client, the installable web app (PWA), the downloadable Android package (APK), the server software, application programming interfaces, databases, user interfaces, graphics, layouts, source and object code, and all related documentation (collectively, the "Platform") are and shall remain the exclusive property of JXMSN LLC, PO Box 393394, Dubai, United Arab Emirates, or its licensors. Except for the limited rights of use expressly granted under these Terms, no right, title, or interest in the Platform is transferred to you. All rights not expressly granted are reserved by JXMSN LLC.

The name "MakZens", the MakZens logo, and all associated names, marks, slogans, product names, and trade dress are trademarks, service marks, or protected signs of JXMSN LLC, whether registered under [insert registration number] or protected as unregistered marks. You may not use, reproduce, or display any such mark without the prior written consent of JXMSN LLC, and any goodwill arising from unauthorised use shall accrue solely to JXMSN LLC. Nothing in these Terms grants you any licence to use the MakZens marks except as strictly necessary to use the service for its intended purpose.

Subject to your continued compliance with these Terms, JXMSN LLC grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to install and use the Platform on your compatible devices solely for your own lawful personal or internal business communications. This licence covers use of the Android APK obtained from the official MakZens website, the installable PWA on iPhone or iPad, and the browser web client, including multi-device access via QR web login. The licence does not permit any commercial redistribution, resale, or provision of the Platform as a service to third parties.

You retain ownership of, and all intellectual property rights in, the content that you create, send, or upload through the Platform, including text messages, voice messages, photographs, files, location data, message reactions, and replies (collectively, "User Content"). By transmitting User Content, you grant JXMSN LLC a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, transmit, display, and route that User Content solely to the extent technically necessary to operate the service and deliver it to your intended recipients. This licence exists only to enable the functioning of the messaging service and terminates when the relevant User Content is deleted from the Platform, subject to routine backup retention and applicable legal retention obligations.

You expressly acknowledge and authorise that the core cross-language messaging function requires the text of your messages to be transmitted to and processed by third-party artificial intelligence and large-language-model translation processors for the sole purpose of generating real-time translations. To enable this, you grant JXMSN LLC and its translation subprocessors a limited licence to transmit, process, and temporarily handle both the original and translated text of your messages. This licence is strictly confined to performing translation and returning the translated output to the messaging flow, and does not authorise any translation processor to assert ownership over your User Content.

The machine-generated translations produced by the third-party translation processors are provided on an as-is basis and are supplied to you as a functional output of the service. To the extent any intellectual property rights subsist in such translated output, they are made available to you and your recipients under the same terms as your underlying User Content, and JXMSN LLC makes no proprietary claim over the substantive meaning of your communications. JXMSN LLC does not warrant the accuracy, completeness, or fitness of any translation and reserves all rights in the translation orchestration technology, prompts, and pipelines that it develops.

You shall not, and shall not permit any third party to, copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying structure, ideas, or algorithms of the Platform, including the distributed APK binary and the PWA and web client assets, except to the limited extent that such restriction is expressly prohibited by applicable mandatory law. You shall not remove, obscure, or alter any proprietary notices, watermarks, or attributions contained in or on the Platform. Any modification, unpacking, repackaging, or unauthorised redistribution of the MakZens APK is strictly prohibited.

The Platform incorporates or interoperates with third-party components and services, including the third-party AI and LLM translation providers, the NowPayments payment processor, the JokerX system for referral settlement and NFT verification, and other subprocessors. All intellectual property rights in such third-party components, services, and marks remain vested in their respective owners, and nothing in these Terms grants you any right in respect of them. Your use of any third-party component may be subject to that provider's own terms and licences, which you agree to observe where applicable.

If you provide JXMSN LLC with any feedback, suggestions, ideas, feature requests, bug reports, or other input concerning the Platform, you grant JXMSN LLC a perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable licence to use, exploit, and incorporate such feedback for any purpose without any obligation of compensation, attribution, or confidentiality to you. This provision applies regardless of whether the feedback is marked as confidential. You waive, to the maximum extent permitted by applicable law, any moral rights or similar claims in respect of such feedback.

You shall not use any automated means, including bots, scrapers, crawlers, or data-mining tools, to access, extract, index, or harvest any part of the Platform, its content, or its underlying databases. In particular, you shall not use the Platform, any User Content, translated output, or any data obtained through the service to train, fine-tune, or develop any machine-learning or artificial-intelligence model, save for the translation processing expressly performed by the Platform's own contracted providers. Any such unauthorised extraction or use constitutes an infringement of JXMSN LLC's rights and a material breach of these Terms.

The proprietary methods by which the Platform performs contacts matching, including the hashing of email addresses to identify mutual contacts without exposing plaintext identifiers, together with the associated data structures and processing logic, constitute confidential and proprietary trade secrets of JXMSN LLC. You shall not attempt to reverse the hashing scheme, reconstruct source identifiers, or replicate the contacts-matching mechanism. The provision of this feature is subject to applicable data-protection law, including the EU and EEA General Data Protection Regulation and UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, and does not grant you any right in the underlying technology.

Participation in the MakZens referral programme, under which partners share a personal referral link and commissions are settled through the third-party JokerX system, does not confer upon you any ownership of, or licence to modify, the MakZens brand assets, marketing materials, or referral infrastructure. Any promotional materials or brand assets that JXMSN LLC makes available for referral use are licensed to you on a limited, revocable basis solely for the purpose of promoting the service in an accurate and non-misleading manner. JXMSN LLC may revoke such use and require the removal of any brand asset at any time.

The optional premium unlock available through verification of a third-party "JokerX" NFT, effected by a server-to-server check and a one-time confirmation code, confers on you no intellectual property rights in the NFT, the JokerX system, or any associated artwork or metadata beyond those, if any, granted by the issuer of that NFT. MakZens neither issues, custodies, nor conveys any rights in such NFT and merely verifies its status to determine entitlement to premium features. Nothing in these Terms shall be construed as a transfer or licence of any rights subsisting in third-party NFTs or blockchain assets.

Premium features obtained through payment in USDC stablecoin on the Solana or BSC networks, processed by the third-party payment processor NowPayments, grant you only the access rights to the paid features described at the point of purchase and confer no intellectual property rights in the Platform. JXMSN LLC does not custody cryptocurrency and provides no wallet, exchange, investment, or financial-advisory service, and retains all rights in the premium functionality irrespective of any payment made. All intellectual property rights in the NowPayments service and its interfaces remain with that processor.

In respect of voice messages, voice and video calls, shared photographs, files, and location data, you grant JXMSN LLC only the limited technical licence necessary to transmit, encode, relay, and deliver such media to your intended recipients and to operate features such as disappearing messages, message reactions, replies, edits, and deep links. You represent and warrant that you hold all necessary rights in any media, files, or third-party content that you transmit through the Platform and that such transmission does not infringe the intellectual property or privacy rights of any person. JXMSN LLC asserts no ownership over your media beyond this operational licence.

JXMSN LLC respects the intellectual property rights of others and will respond to properly substantiated notices of alleged infringement concerning content transmitted through the Platform. If you believe that any content accessible through MakZens infringes your intellectual property rights, you may submit a written notice to [insert IP notice address], legal@makzens.app, identifying the protected work, the allegedly infringing material, and your contact details, together with a good-faith statement of your claim. JXMSN LLC reserves the right to remove or disable access to allegedly infringing content and to suspend or terminate the accounts of repeat infringers.

Upon termination or expiry of your right to use the Platform for any reason, all licences granted to you under this section shall immediately cease, and you shall discontinue use of the Platform, including uninstalling the APK or PWA and ceasing use of the web client and any MakZens brand assets. Termination shall not affect the licence granted by you to JXMSN LLC in respect of User Content already lawfully processed, nor any accrued rights, and the provisions of this section that by their nature should survive shall continue in force. This section and all matters relating to intellectual property hereunder are governed by, and shall be construed in accordance with, the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, subject to the mandatory protections of applicable data-protection regimes including the GDPR and UAE PDPL.

MakZens is operated by JXMSN LLC (PO Box 393394, Dubai, United Arab Emirates) and relies on a range of independent third parties to deliver its functionality, including third-party artificial intelligence and large-language-model providers used to translate messages, the payment processor NowPayments, and the JokerX referral and NFT-verification system. These third parties are separate legal entities acting on their own account and are not agents, employees or subcontractors under the control of JXMSN LLC for the purposes of their own services. Except where these Terms or the Privacy Policy expressly state otherwise, JXMSN LLC does not warrant, endorse or assume responsibility for the acts, omissions, availability or content of any such third party.

The core cross-language messaging function of MakZens operates by transmitting the text of your messages, together with reactions, replies and edited content where applicable, to third-party AI and large-language-model translation providers so that each message can be automatically translated in real time. By sending a message through the Service you acknowledge and instruct that the original and translated text will be processed by these external translation processors for the sole purpose of producing the translation, and that JXMSN LLC does not control the internal models, training practices or infrastructure of those providers. You should not transmit through the Service any information that you are contractually or legally prohibited from disclosing to an external processor.

Machine translation is inherently imperfect and the output generated by the third-party translation providers may contain inaccuracies, omissions, ambiguities or contextually inappropriate renderings, particularly for idiomatic expressions, slang, technical terminology, mixed-language input or voice messages that have been transcribed. JXMSN LLC provides the translation feature on an as-available basis and does not warrant that any translation will be accurate, complete or fit for any particular purpose, and you assume all risk arising from reliance on translated content. For communications with legal, medical, financial or safety-critical consequences you should obtain independent professional human translation.

Optional premium plans, whether offered as a one-time purchase or as a recurring subscription, are settled in USDC stablecoin on the Solana or BSC networks and are processed exclusively by NowPayments, a third-party payment processor. JXMSN LLC does not receive, hold or process your wallet credentials, private keys or on-chain transaction authorisations, and all payment acceptance, confirmation, refund handling and dispute resolution at the processing layer are governed by the separate terms and privacy policy of NowPayments. You are responsible for reviewing and accepting the applicable NowPayments terms before completing any payment.

JXMSN LLC does not custody cryptocurrency and does not provide any wallet, exchange, brokerage, staking, custody, investment or financial-advisory service of any kind. The Service does not hold digital assets on your behalf, and any USDC used to pay for premium features is transferred by you directly through NowPayments and the relevant blockchain network. Blockchain transactions are irreversible, and network fees, confirmation times, token pricing and chain availability are determined by the Solana or BSC networks and by NowPayments, over which JXMSN LLC exercises no control.

The alternative premium unlock is available through verification of a third-party JokerX NFT by means of a server-to-server check followed by a one-time confirmation code, and at no point does the Service request, connect to or interact with your cryptocurrency wallet. The existence, validity, ownership status and entitlement associated with any JokerX NFT are determined by the JokerX system and the underlying blockchain, and JXMSN LLC merely verifies the result of that external check. JXMSN LLC is not responsible for the issuance, transfer, revocation, valuation or continued recognition of any NFT, nor for the availability of the JokerX verification endpoint.

The MakZens referral programme allows partners to share a personal referral link, and any resulting commissions are calculated, tracked and settled by the third-party JokerX system rather than by JXMSN LLC. Your eligibility for and entitlement to referral commissions, including the applicable rates, qualification criteria, payment timing and payout methods, are governed by the JokerX programme rules as they may be amended from time to time. JXMSN LLC does not guarantee any level of referral earnings and is not liable for delayed, reduced, withheld or unpaid commissions arising from the operation of the JokerX system.

The contacts-matching feature enables you to discover which of your existing contacts already use MakZens by comparing hashed representations of email addresses rather than transmitting raw contact details in plaintext for that purpose. Where the feature depends on address-book information stored on your device or on device platform services, your use of it is additionally subject to the terms and permissions of the underlying operating system and any relevant third-party platform provider. You represent that you have any consent or authority required under applicable law before submitting information relating to third parties for matching.

MakZens is distributed for Android devices as a direct APK download from the MakZens website and for iPhone and iPad as an installable progressive web application, in addition to a browser-based web client, and it is not distributed through the Apple App Store or Google Play for the direct-download path. Because the direct-download and PWA channels operate outside those application stores, the review, refund, security-scanning and update mechanisms of Apple and Google do not apply, and you are responsible for enabling installation from the relevant source and for verifying that you have obtained the application from the official MakZens website. JXMSN LLC does not warrant that the browser, operating system, device or network you use will support all features of the Service.

Certain features of MakZens, including voice and video calls, voice messages, photo and file sharing, location sharing, push notifications, message deep links and multi-device access via QR web login, may depend upon or route through third-party infrastructure such as network operators, hosting providers, real-time communication services, content-delivery networks and push-notification gateways. The availability, latency, quality and security of these features are influenced by such third parties, and JXMSN LLC does not guarantee uninterrupted or error-free operation. Any interruption, degradation or failure attributable to a third-party provider is outside the reasonable control of JXMSN LLC.

Push notifications delivered by MakZens are designed to protect message confidentiality, and the transmitted push payload carries only the sender identity together with a generic placeholder rather than the substantive content of the message, with the actual message text retrieved and rendered on your device after delivery. Delivery of push notifications nonetheless depends on the push-notification services of your device platform provider and on your device settings, and JXMSN LLC cannot guarantee that any notification will be delivered promptly or at all. You are responsible for managing your notification permissions at the device and operating-system level.

The Service may contain links, previews, deep links or references to external websites, resources, wallets, blockchain explorers or applications that are operated by third parties and are provided solely for convenience. The inclusion of any such link does not constitute an endorsement, verification or assumption of responsibility by JXMSN LLC for the content, accuracy, security, legality or privacy practices of the linked destination. You access external links and third-party destinations at your own risk and should review the applicable terms and privacy policies of each such destination before relying on it.

Where third-party processors act on behalf of JXMSN LLC in the processing of personal data, including the translation providers, NowPayments and push-notification and hosting providers, JXMSN LLC endeavours to engage them under written arrangements that reflect the requirements of the EU and EEA General Data Protection Regulation and of the United Arab Emirates Personal Data Protection Law (Federal Decree-Law No. 45 of 2021). Because the Service is offered to a global audience, personal data, including message text submitted for translation, may be transferred to and processed in jurisdictions outside your country of residence, and JXMSN LLC relies on appropriate transfer mechanisms where required by applicable law. Further detail on the identity of processors, the categories of data shared and the applicable safeguards is set out in the MakZens Privacy Policy.

You may exercise data-protection rights in relation to personal data processed through third-party services, including rights of access, rectification, erasure, restriction, objection and data portability to the extent provided under the GDPR, the UAE PDPL or other applicable law, by contacting JXMSN LLC at [privacy@makzens.app]. Where a request concerns data held or processed independently by a third party such as NowPayments or the JokerX system, JXMSN LLC will use reasonable efforts to facilitate your request but you may also need to address that third party directly under its own policies. JXMSN LLC will respond to verified requests within the timeframes required by the applicable data-protection regime.

JXMSN LLC does not control and is not responsible for changes that third-party providers may make to their services, including modifications, deprecations, price changes, suspensions or discontinuation of any translation model, payment method, blockchain network, NFT-verification endpoint or referral facility. Should any third-party service become unavailable or commercially unreasonable, JXMSN LLC reserves the right to substitute an alternative provider, to modify the affected feature or to discontinue it, subject to your rights under applicable consumer-protection and data-protection law. JXMSN LLC will use reasonable efforts to give notice of material changes affecting paid features where practicable.

To the maximum extent permitted by applicable law, JXMSN LLC excludes all liability for loss or damage arising from or in connection with the acts, omissions, unavailability, security incidents or content of any third-party service referred to in these Terms, including the translation providers, NowPayments, the Solana and BSC networks, the JokerX system and any linked external destination. Nothing in this section limits or excludes any liability that cannot lawfully be limited or excluded, including liability under mandatory provisions of the GDPR, the UAE PDPL or applicable consumer law. Your statutory rights as a consumer, where they apply, remain unaffected by this section.

These Terms, including this section on third-party services, processors and external links, are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and the courts of Dubai shall have jurisdiction over any dispute arising out of or in connection with them, without prejudice to any mandatory rights you may enjoy under the law of your country of residence. Where a conflict arises between these Terms and the separate terms of a third-party provider in respect of that provider's own service, the third-party terms shall govern the relationship between you and that provider. To the extent any provision of this section is held invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

JXMSN LLC (the "Operator") may suspend, restrict or terminate a user's access to MakZens, in whole or in part, where the user materially breaches these Terms, uses the service unlawfully, or engages in conduct that endangers the integrity, security or availability of the platform or other users. Depending on the severity of the conduct, the Operator may act by way of a temporary suspension of specific features (for example real-time translation, voice or video calling, channel creation, or file sharing) or by a full and permanent termination of the account. Where circumstances reasonably permit, the Operator will give the user prior notice and an opportunity to remedy the breach before terminating, but it reserves the right to act immediately where continued access poses a risk of harm, legal liability or ongoing abuse.

The Operator may suspend or terminate an account with immediate effect and without prior notice where it has reasonable grounds to believe that the user has engaged in serious misconduct, including but not limited to distribution of unlawful content, harassment or exploitation of other users, circumvention of the security controls of the direct APK download or the installable web app (PWA), unauthorised automated access or scraping, or attempts to compromise the third-party artificial-intelligence and large-language-model providers that perform message translation. In such cases the user acknowledges that immediate action is necessary and proportionate to protect the platform, its users and affected third parties. The Operator will, where lawful and practicable, notify the user of the reason for the action after it has been taken.

Because every message on MakZens is transmitted to third-party AI and LLM translation processors for real-time translation of original and translated text, the Operator may suspend an account where a user's messaging patterns indicate abuse of these translation services, such as automated bulk transmission, deliberate injection of content designed to manipulate or attack the language models, or use of the translation pipeline for purposes unrelated to genuine interpersonal communication. The user agrees that such measures protect both the availability of the translation service for the wider user base and the contractual relationships between the Operator and its translation processors. The Operator may, in lieu of full termination, throttle or temporarily disable translation for the affected account.

Where an account is associated with a paid premium plan, suspension or termination for cause does not entitle the user to any refund of one-time purchase fees or unexpired subscription periods, save where a refund is required by applicable mandatory consumer-protection law. All premium payments are made in USDC stablecoin on the Solana or BSC networks and are processed by the third-party payment processor NowPayments; the Operator does not custody cryptocurrency and cannot reverse, recall or refund on-chain settlements through any wallet or exchange facility of its own. Any refund that is legally due will be handled in accordance with the separate refund provisions of these Terms and, where applicable, through NowPayments.

Upon suspension or termination for cause, any premium entitlement obtained through verification of a third-party "JokerX" NFT will likewise cease, and the Operator may revoke the premium status linked to the one-time confirmation code issued following the server-to-server NFT check. The user acknowledges that the underlying NFT remains under their own control on the relevant blockchain and is unaffected by the termination, but that continued eligibility for premium features within MakZens is conditional on ongoing compliance with these Terms. The Operator does not connect to, custody or transact against the user's wallet in performing or revoking this verification.

Where a user participates in the referral programme by sharing a personal referral link, the Operator may suspend or terminate participation in that programme, forfeit accrued but unpaid commissions, and reverse commissions attributable to fraudulent, self-referred, or otherwise abusive sign-ups. Because referral commissions are calculated and settled by the third-party JokerX system rather than by the Operator directly, any dispute concerning the amount or payment of commissions may also be subject to the terms and determinations of that third-party system. Termination of the main MakZens account for cause will ordinarily result in termination of the associated referral entitlement.

A user may terminate their relationship with MakZens at any time and for any reason by ceasing to use the service and by initiating deletion of their account through the in-app account settings or by written request to [privacy@makzens.app]. Voluntary termination by the user does not, of itself, give rise to any right to a refund of premium fees already paid, except where a statutory withdrawal or cancellation right applies. Where the user has an active subscription, the user remains responsible for cancelling any recurring arrangement in accordance with the subscription terms to prevent further billing cycles being initiated through NowPayments.

Upon deletion of an account, the Operator will delete or irreversibly anonymise the user's personal data associated with that account, including profile information, message content stored on the Operator's systems, and the hashed-email identifiers used for the contacts-matching feature, subject to the retention exceptions set out below. The user acknowledges that message content which has previously been delivered to other participants, to their devices, or to public or private channels may persist on those recipients' devices or copies beyond the Operator's control and cannot be recalled by deletion of the sender's account. Disappearing-message settings govern only the automated expiry of messages and do not substitute for account deletion.

Notwithstanding deletion, the Operator may retain certain data for so long as, and to the extent that, retention is required to comply with legal obligations under the laws of the United Arab Emirates and other applicable jurisdictions, to comply with the EU General Data Protection Regulation (GDPR) and the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021) where applicable, to resolve disputes, to prevent fraud and abuse, and to enforce these Terms. Any such retained data will be limited to what is strictly necessary, held securely, and deleted or anonymised once the applicable retention purpose has been fulfilled. Records of payment transactions processed by NowPayments may be retained for the periods mandated by accounting and anti-money-laundering requirements.

The Operator will endeavour to complete deletion of a user's account and associated personal data within [insert number] days of a valid deletion request, subject to technical constraints and the retention exceptions described above. Data held by independent third-party processors, including the AI and LLM translation providers, NowPayments and the JokerX system, is subject to the respective retention and deletion practices of those processors as described in the Privacy Policy, and the Operator will pass on deletion instructions to its processors to the extent contractually and technically possible. Backups may retain residual copies for a limited rolling period before they are overwritten in the ordinary course.

Suspension or termination of an account automatically terminates any linked sessions established through the multi-device feature, including web clients authenticated by QR-code login, and revokes the credentials associated with those sessions. The user is responsible for logging out of and disconnecting all devices prior to voluntary deletion where they wish to prevent continued access, and the Operator may invalidate all active tokens upon termination for cause. Any message deep links referencing content within a terminated account may cease to resolve.

Where the Operator suspends rather than terminates an account, it may impose conditions for reinstatement, including verification of identity, remediation of the breach, or acceptance of updated Terms. A suspended account and its data will be retained for a reasonable holding period during which the user may seek reinstatement or export of their data, after which the Operator may proceed to permanent deletion in accordance with these Terms and its retention schedule. The Operator is under no obligation to reinstate an account where the underlying conduct was serious or recurrent.

The Operator may suspend or terminate access, in whole or in part, where required to do so by a competent court, regulator, or governmental authority, or where necessary to comply with sanctions, export-control, or anti-money-laundering obligations affecting the user, their jurisdiction, or the USDC settlement networks on Solana or BSC used for premium payments. In such circumstances the Operator may be prohibited by law from disclosing the specific reason for the action. The user warrants that they are not located in, or acting on behalf of any person in, a jurisdiction subject to comprehensive sanctions that would render provision of the service unlawful.

The Operator may terminate or suspend the service generally, or discontinue particular features or distribution channels — including the direct APK download for Android, the installable web app for iPhone and iPad, or the browser web client — upon reasonable prior notice to affected users, save where a shorter notice period is justified by security, legal or operational necessity. Because MakZens is not distributed through the Apple App Store or Google Play for the direct-download path, users acknowledge that the Operator alone controls the availability of updates and that discontinuation may render an installed build non-functional over time. Where the service is discontinued in its entirety, the Operator will provide users with a reasonable opportunity to export their data before deletion.

Termination or deletion, however arising, does not affect any rights, obligations or liabilities that accrued prior to the effective date of termination, nor those provisions of these Terms which by their nature are intended to survive, including provisions on intellectual property, disclaimers, limitation of liability, indemnity, data protection, and governing law and jurisdiction. The user's obligation to pay any sums that fell due before termination, and the Operator's obligations under applicable data-protection law, continue to apply. Termination of the referral or premium entitlement does not release either party from obligations that survive by their nature.

Upon the effective date of account deletion the user's licence to use MakZens, its software and its trademarks terminates immediately, and the user must cease all use of the service and, where applicable, remove any installed APK or web-app build from their devices. The user remains bound by any continuing confidentiality or usage restrictions in respect of content or information obtained through the service prior to termination. Nothing in this section obliges the Operator to preserve, and the Operator shall have no liability for the loss of, user content following a validly effected deletion.

Any dispute arising out of or in connection with the suspension, termination or deletion of an account, including the exercise of data-subject rights under the GDPR or the UAE Personal Data Protection Law, shall be governed by and construed in accordance with the laws applicable in Dubai, United Arab Emirates, and shall be subject to the jurisdiction agreed in the general provisions of these Terms. The exercise of statutory data-protection rights by users in the EU/EEA or the UAE is without prejudice to, and shall be handled in parallel with, the contractual mechanisms set out in this section. Users may direct data-protection enquiries and complaints to the Operator at [privacy@makzens.app] or to JXMSN LLC, PO Box 393394, Dubai, United Arab Emirates.

The MakZens service, including all messaging, translation, calling, and premium functionality, is provided by JXMSN LLC on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted under the laws of Dubai, United Arab Emirates, and to the extent applicable the General Data Protection Regulation and UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, we expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No advice or information, whether oral or written, obtained from us or through the service creates any warranty not expressly stated in these Terms.

MakZens performs automatic cross-language translation of messages, message previews, and other user content by transmitting that content to third-party artificial intelligence and large language model providers acting as translation processors. We make no warranty as to the accuracy, completeness, fidelity, tone, cultural appropriateness, or fitness of any machine translation, and translated output may contain errors, omissions, mistranslations, or hallucinated content. You acknowledge that you rely on translated messages at your own risk and that translations must not be used for medical, legal, financial, safety-critical, or other high-stakes purposes without independent human verification.

We do not warrant that any message will be delivered, translated, or displayed in a timely manner, in the correct order, or at all, and we disclaim liability for delays, failures, or interruptions in the delivery of one-to-one chats, group chats, public or private channels, voice messages, or deep-linked messages. Message delivery depends on network conditions, device availability, third-party infrastructure, and the operation of translation processors outside our control. Disappearing messages, edits, and deletions are provided as convenience features and are not guaranteed to remove content from every device, cache, backup, or recipient copy.

Voice calls, video calls, and voice messages are provided without any warranty as to connection quality, latency, audio or video fidelity, availability, or uninterrupted operation, and such features are not intended or guaranteed to function as, or as a substitute for, emergency communication services. MakZens does not support emergency calls to public safety answering points, and you must maintain an alternative means of contacting emergency services. We disclaim all liability arising from any inability to reach emergency, medical, or crisis services through the application.

Contacts matching is performed by comparing hashed representations of email addresses to identify other users, and we make no warranty that this process will correctly identify, or refrain from suggesting, any particular contact. Matches may be incomplete, absent, or unexpected, and the presence or absence of a suggested contact does not confirm any person's identity, registration status, or willingness to communicate. You are solely responsible for verifying the identity of any person with whom you communicate through the service.

Because MakZens for Android is distributed as a direct APK download from our website and for iPhone and iPad as an installable progressive web application rather than through the Apple App Store or Google Play, we do not warrant that the application is reviewed, notarised, sandboxed, or automatically updated by any app-store operator. You are responsible for verifying that any APK you install originates from our official source, for maintaining device security, and for applying updates, and we disclaim liability for any harm arising from tampered, modified, side-loaded, or outdated builds obtained from unofficial channels. We make no warranty that the progressive web application or browser web client will function identically across all devices, browsers, or operating-system versions.

Multi-device access, including web login by QR code, is provided without warranty that linked sessions will remain synchronised, secure against a compromised device, or free from unauthorised access where you fail to protect your credentials or physical devices. You are solely responsible for keeping linked devices secure, for revoking sessions you no longer control, and for the consequences of scanning login codes. We disclaim liability for any access to your account obtained through a device or session that you have linked, authorised, or failed to revoke.

Optional premium plans, including one-time purchases and subscriptions, are paid in USDC stablecoin on the Solana or BNB Smart Chain networks and are processed exclusively by NowPayments, a third-party payment processor over which we exercise no control. We do not custody, hold, transmit, or manage cryptocurrency, provide no wallet, exchange, brokerage, custody, investment, or financial-advisory service, and give no warranty regarding the availability, pricing, confirmation times, or finality of any blockchain transaction. We are not responsible for losses arising from network congestion, failed or misdirected transfers, incorrect wallet addresses, chain reorganisations, stablecoin de-pegging, gas fees, or the acts, omissions, or insolvency of NowPayments or any blockchain network.

You acknowledge that transactions settled on public blockchains are generally irreversible and that we cannot reverse, recall, or refund a completed on-chain payment except as expressly required by mandatory applicable law. We give no warranty as to the value, stability, convertibility, or legal or tax treatment of USDC or any other digital asset, and nothing in the service constitutes financial, investment, tax, or legal advice. You are solely responsible for determining the regulatory and tax consequences of your use of digital assets in your jurisdiction.

The alternative premium unlock via verification of a third-party "JokerX" NFT is performed through a server-to-server check and a one-time confirmation code, and does not involve connecting a wallet within the application. We make no warranty as to the availability, authenticity, ownership, transferability, or continued validity of any JokerX NFT, nor that a given verification will succeed, and we are not responsible for the operation, discontinuation, or security of the JokerX system or the underlying NFT contracts. Loss, transfer, or compromise of an NFT or confirmation code may result in loss of the associated premium access without any obligation on our part to compensate you.

The referral programme allows partners to share a personal link, but commissions are calculated, attributed, and settled entirely by the third-party JokerX system, which we do not operate or control. We give no warranty as to the accuracy of referral tracking, the amount, timing, or payment of any commission, or the continued operation of the referral programme, and we may modify or discontinue it at any time. Participation confers no entitlement to any guaranteed earnings, and we disclaim all liability for disputes arising from referral attribution or commission settlement performed by JokerX.

MakZens relies on numerous third-party providers and infrastructure, including translation AI and LLM processors, NowPayments, the JokerX and NFT systems, push-notification gateways, hosting, and blockchain networks, and we do not warrant the availability, security, accuracy, or continued operation of any such third party. Any interruption, degradation, data incident, or change by a third-party provider may affect the service without giving rise to any liability on our part. Your use of features dependent on third parties is subject to those parties' own terms, and we disclaim responsibility for their acts and omissions to the fullest extent permitted by law.

We do not warrant that the service will be uninterrupted, secure, timely, error-free, or free of viruses, malware, or other harmful components, nor that any defects will be corrected. We may suspend, restrict, or withdraw the service or any feature, in whole or in part, for maintenance, security, legal, or operational reasons, with or without notice, and without liability. You are responsible for maintaining your own backups of important content, as we do not guarantee the retention, recoverability, or continued availability of any message, file, media, or account data.

Push notifications are provided as a convenience and are dispatched through third-party push gateways whose payloads carry only the sender and a generic placeholder rather than message content, with the notification text loaded on-device thereafter. We do not warrant that push notifications will be delivered, delivered on time, or displayed correctly, and delivery depends on device settings, operating-system behaviour, and gateway availability outside our control. You should not rely on push notifications as the sole means of receiving time-sensitive information.

MakZens is a communications tool and does not monitor, screen, verify, endorse, or assume responsibility for any user content, including original or translated messages, media, files, location data, reactions, replies, or channel content. We make no warranty regarding the legality, accuracy, or appropriateness of content transmitted by users, and you are solely responsible for the content you send, share, or receive, including its compliance with applicable law. To the fullest extent permitted by law, we disclaim all liability arising from user content and from your interactions with other users.

While we implement technical and organisational measures and process personal data in accordance with our Privacy Policy, the General Data Protection Regulation, and UAE Federal Decree-Law No. 45 of 2021, we do not warrant that any transmission or storage is absolutely secure or that unauthorised access, interception, or disclosure will never occur. You acknowledge that message content is transmitted to third-party translation providers to perform translation and that no method of electronic transmission or storage is completely secure. Any questions regarding data protection may be directed to [privacy@makzens.app].

Some jurisdictions do not permit the exclusion of certain warranties or the limitation of certain rights, and nothing in this section is intended to exclude or restrict any warranty, right, or remedy that cannot lawfully be excluded or restricted under mandatory applicable law, including consumer-protection rights that may apply to users in the EU/EEA or the UAE. Where such a warranty or right cannot be excluded, our liability is limited to the minimum extent permitted by that law. Except to that extent, these disclaimers apply to the maximum extent permitted and are governed by and construed in accordance with the laws of Dubai, United Arab Emirates.

The MakZens service, including its cross-language messaging, group chats, public and private channels, voice and video calling, file and location sharing, and all related functionality, is provided by JXMSN LLC on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by the laws of Dubai, United Arab Emirates, JXMSN LLC disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. No advice or information, whether oral or written, obtained by you from JXMSN LLC or through the service shall create any warranty not expressly stated in these Terms.

You acknowledge that every message sent through MakZens is automatically translated in real time by third-party artificial intelligence and large language model providers acting as translation processors, and that such automated translation is inherently imperfect. JXMSN LLC does not warrant the accuracy, completeness, tone, cultural appropriateness, or fitness of any translated text, and shall not be liable for any loss, misunderstanding, dispute, or damage arising from a mistranslation, omission, or distortion of meaning between the original and translated content. You are solely responsible for verifying the meaning of any communication before relying upon it, and you bear all risk arising from your reliance on machine-translated output.

Where a message, its translation, or any transmitted content contains errors, delays, or fails to be delivered because of the acts, omissions, outages, or model behaviour of a third-party translation processor, network operator, or hosting provider, JXMSN LLC shall bear no liability for the resulting consequences. You agree that the routing of message text to external translation providers to perform the translation function is an essential and disclosed feature of the service, and that JXMSN LLC does not guarantee the availability, latency, or continued operation of any particular third-party provider.

All premium purchases and subscriptions are settled in USDC stablecoin on the Solana or BSC networks through NowPayments, an independent third-party payment processor, and JXMSN LLC neither controls nor assumes responsibility for the acts, omissions, security, or availability of that processor or of the underlying blockchain networks. JXMSN LLC shall not be liable for any loss arising from failed, delayed, mispriced, or misdirected transactions, network congestion, gas fees, wallet errors, incorrect addresses, or fluctuations in the value of any digital asset. You accept that blockchain transactions are generally irreversible and that JXMSN LLC cannot reverse, refund, or recover a payment once confirmed on-chain except as expressly required by applicable law.

JXMSN LLC does not custody, hold, transmit, or manage any cryptocurrency, private keys, or wallets on your behalf, and provides no wallet, exchange, investment, brokerage, or financial-advisory service of any kind. Nothing in the service constitutes financial, tax, or legal advice, and JXMSN LLC shall not be liable for any decision you make to acquire, hold, or dispose of USDC or any other digital asset in connection with your use of MakZens. You are solely responsible for the security of your own wallet, credentials, and devices.

The alternative premium unlock based on verification of a third-party "JokerX" NFT operates through a server-to-server check and a one-time confirmation code, and JXMSN LLC does not issue, endorse, value, or guarantee any NFT or the JokerX system. JXMSN LLC shall not be liable for the authenticity, ownership, validity, transfer, or continued recognition of any NFT, nor for any failure, downtime, or erroneous result of the third-party verification process. Access granted through this mechanism may be modified or withdrawn if the underlying third-party verification ceases to function or returns an invalid result.

The MakZens referral programme allows partners to share a personal link, and all commissions and payouts arising from it are calculated and settled exclusively by the third-party JokerX system rather than by JXMSN LLC. JXMSN LLC makes no representation as to the amount, timing, eligibility, or payment of any referral commission and shall not be liable for the calculation, delay, non-payment, or clawback of any such commission. You participate in the referral programme at your own risk and shall not hold JXMSN LLC responsible for the conduct or solvency of the JokerX system or of any referred party.

You acknowledge that the MakZens Android application is distributed as a direct APK download from the website and the iPhone and iPad experience is provided as an installable progressive web app, and that neither is distributed through the Apple App Store or Google Play for the direct-download path. JXMSN LLC shall not be liable for any harm arising from your decision to install software outside of official application stores, including any device incompatibility, security exposure, loss of data, or interference with your operating system. You are responsible for maintaining the security, updates, and integrity of the devices on which you install or access MakZens.

The contacts matching feature operates by comparing hashed representations of email addresses to suggest connections, and JXMSN LLC does not warrant that such matching will be accurate, complete, or free of false positives or false negatives. JXMSN LLC shall not be liable for any failure to match a contact, any incorrect match, or any consequence arising from your reliance on the discovery, presence, or absence of a contact within the service. You remain responsible for confirming the identity of any person with whom you communicate.

JXMSN LLC shall not be liable for any interception, unauthorised access, quality degradation, dropped connection, or failure of voice messages, voice or video calls, disappearing messages, message reactions, replies, edits, deep links, or multi-device QR web login sessions, whether caused by third-party network conditions, device limitations, or events beyond its reasonable control. The disappearing-message and edit features are provided as convenience functions and do not guarantee that a recipient has not retained, copied, forwarded, or captured content before it disappeared or was edited. You bear all risk associated with the content you choose to share and the persons with whom you share it.

To the maximum extent permitted by applicable law, the total aggregate liability of JXMSN LLC and its officers, directors, employees, and affiliates arising out of or relating to the service or these Terms shall not exceed the greater of the total amount actually paid by you to JXMSN LLC for premium access during the three months immediately preceding the event giving rise to the claim, or fifty United States dollars. This limitation applies cumulatively across all claims and causes of action, whether in contract, tort, statute, or otherwise. The existence of multiple claims shall not enlarge this cap.

In no event shall JXMSN LLC be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings, arising out of or in connection with the service, even if JXMSN LLC has been advised of the possibility of such damages. This exclusion applies regardless of the theory of liability and regardless of whether the damages arise from the use of, or inability to use, translation, messaging, payment, referral, or any other feature of MakZens.

Nothing in these Terms shall exclude or limit the liability of JXMSN LLC to the extent that such exclusion or limitation is prohibited by mandatory applicable law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded under the General Data Protection Regulation, the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, or other applicable data-protection or consumer-protection legislation. Where any provision of this section is held unenforceable in a particular jurisdiction, the remaining provisions and the liability caps shall continue to apply to the fullest extent permitted. The rights of consumers under any non-waivable statutory provision remain unaffected.

JXMSN LLC shall not be liable for any delay in or failure of performance resulting from causes beyond its reasonable control, including acts of God, war, terrorism, civil unrest, governmental action, changes in law or sanctions affecting digital-asset payments, failures of telecommunications or internet infrastructure, blockchain network disruptions, cyber-attacks, or the suspension, degradation, or discontinuation of services by third-party translation, payment, hosting, or verification providers. During the continuance of any such event, the obligations of JXMSN LLC shall be suspended to the extent affected, and JXMSN LLC shall not be deemed to be in breach of these Terms. JXMSN LLC will use commercially reasonable efforts to resume performance as soon as practicable.

You agree to indemnify, defend, and hold harmless JXMSN LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to your use or misuse of MakZens, your violation of these Terms, or your infringement of any right of a third party. This obligation applies to claims brought by other users, by third-party providers, or by any regulatory or governmental authority. JXMSN LLC reserves the right to assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate fully at your own expense.

Your indemnification obligation extends specifically to any claim arising from the content you transmit, including its original and machine-translated forms, any unlawful, defamatory, infringing, or harassing use of the messaging, channel, calling, file-sharing, or location-sharing features, and any breach by you of the data-protection obligations you owe to individuals whose contact information, including hashed email data, you introduce into the service. You warrant that you have obtained any consent required under the General Data Protection Regulation, the UAE PDPL, or other applicable law before sharing the personal data of any third party through MakZens. JXMSN LLC shall not be liable for, and you shall indemnify it against, any claim resulting from your failure to obtain such consent.

You further agree to indemnify JXMSN LLC against any claim, loss, or regulatory action arising from your participation in the referral programme, your representations to referred parties, your acquisition or disposal of USDC or any NFT used to obtain premium access, or your dealings with NowPayments, the JokerX system, or any other third-party processor. This indemnity survives the termination of your account and the cessation of your use of the service. The indemnities set out in this section are in addition to, and not in substitution for, any other remedy available to JXMSN LLC at law or in equity under the governing law of Dubai, United Arab Emirates.

These Terms and Conditions, together with the MakZens Privacy Policy and any supplemental terms applicable to Premium plans, the JokerX/NFT unlock or the referral programme, constitute the entire agreement between you and JXMSN LLC (PO Box 393394, Dubai, United Arab Emirates) governing your use of the MakZens messaging service and supersede all prior understandings on the same subject matter. In the event of any conflict between these Terms and any supplemental terms, the supplemental terms shall prevail solely with respect to the specific feature they govern. Marketing statements, help-centre articles and in-app descriptions are provided for guidance only and do not form part of this agreement unless expressly incorporated by reference.

This agreement and any dispute or claim arising out of or in connection with it, its subject matter or formation (including non-contractual disputes or claims, the real-time translation of messages by third-party AI providers, Premium payments processed in USDC via NowPayments, and JokerX referral or NFT-verification matters) are governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The application of any conflict-of-laws rules that would result in the laws of another jurisdiction being applied is expressly excluded. Where mandatory consumer-protection or data-protection provisions of your country of habitual residence in the EU/EEA afford you protections that cannot be derogated from by agreement, those protections remain unaffected.

Subject to the mandatory rights described elsewhere in this section, the parties irrevocably agree that the courts of the Dubai International Financial Centre (DIFC) shall have exclusive jurisdiction to settle any dispute arising out of or in connection with this agreement or your use of MakZens. Before commencing proceedings, each party shall use reasonable endeavours to resolve the dispute amicably by written notice to the other, with JXMSN LLC contactable for this purpose at [insert legal contact email] and users contactable at the email address associated with their MakZens account. This clause does not prevent JXMSN LLC from seeking urgent injunctive or interim relief in any court of competent jurisdiction to protect its intellectual property, service integrity or user safety.

Nothing in the governing-law and jurisdiction provisions of these Terms deprives a consumer resident in the European Union or European Economic Area of the protection of the mandatory rules of the law of their country of residence, nor of the right to bring proceedings in the courts of that country where such right is guaranteed by applicable law. The European Commission provides an Online Dispute Resolution platform accessible at https://ec.europa.eu/consumers/odr, although JXMSN LLC is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board. Consumers may also contact their local consumer-protection authority regarding any grievance concerning the MakZens service.

JXMSN LLC processes personal data in accordance with the MakZens Privacy Policy and, where applicable, with Regulation (EU) 2016/679 (the General Data Protection Regulation) for users in the EU/EEA and with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) for users in the United Arab Emirates. Because MakZens transmits message text to third-party AI and large-language-model translation providers to perform real-time cross-language translation, and transmits payment information to NowPayments to process USDC Premium payments, your use of these features necessarily involves the international transfer and processing of data as described in the Privacy Policy. Any dispute concerning the lawfulness of such processing shall be addressed in the first instance through the data-subject request channels set out in that policy.

You acknowledge that the MakZens service depends on third-party processors whose availability, performance and terms are outside the reasonable control of JXMSN LLC, including the AI and large-language-model providers that perform message translation, NowPayments as payment processor for USDC settlements on the Solana and BSC networks, the underlying blockchain networks themselves, and the JokerX system that verifies NFTs and settles referral commissions. JXMSN LLC does not custody cryptocurrency, does not operate a wallet, exchange, investment or financial-advisory service, and is not responsible for the acts, omissions, fees, exchange rates, confirmation times or outages of any such third party or blockchain network. Your dealings with these processors may be subject to their own terms, which you are responsible for reviewing.

JXMSN LLC may amend these Terms from time to time to reflect changes in the MakZens service, its third-party translation, payment or referral processors, applicable law, or its legitimate business interests. Material changes will be notified to you in advance by a reasonable means, which may include an in-app notice, a banner within the MakZens client, or a message to the email address associated with your account, no less than the notice period required by applicable law. Your continued use of MakZens after the effective date of the revised Terms constitutes acceptance of them; if you do not agree to the changes, your sole remedy is to discontinue use of the service and, where applicable, cancel any Premium subscription in accordance with its cancellation terms.

JXMSN LLC reserves the right to modify, suspend, add to or discontinue any feature of MakZens at any time, including 1:1 and group chats, public or private channels, voice messages, voice and video calls, photo and file sharing, location sharing, message reactions, replies, editing, disappearing messages, contacts matching by hashed email, message deep links, multi-device QR web login and push notifications. Where a feature depends on a third-party processor, its withdrawal or degradation by that processor may require JXMSN LLC to alter or remove the corresponding functionality without liability. JXMSN LLC will use reasonable efforts to give advance notice of the permanent discontinuation of a material feature except where immediate action is required for legal, security or safety reasons.

Neither party shall be liable for any failure or delay in performing its obligations under this agreement to the extent that such failure or delay results from an event of force majeure, meaning any circumstance beyond its reasonable control. Such circumstances include, without limitation, acts of God, war, terrorism, civil unrest, epidemic or pandemic, government or regulatory action, sanctions affecting cryptocurrency or the parties, failure or outage of the internet, telecommunications, hosting infrastructure or public utilities, and the failure, suspension, congestion or discontinuation of essential third-party services such as the AI translation providers, NowPayments, the Solana or BSC blockchain networks, or the JokerX system. The affected party shall notify the other as soon as reasonably practicable and shall use reasonable endeavours to mitigate the effects of the event.

Because MakZens Android software is distributed as a direct APK download from the MakZens website and the iPhone and iPad client is provided as an installable progressive web application (PWA) rather than through the Apple App Store or Google Play, you are responsible for ensuring that installing and running such software is permitted on your device and lawful in your jurisdiction. JXMSN LLC provides the APK and PWA on an as-available basis and does not warrant that they are compatible with every device, operating-system version or browser, or that any particular device security control will permit their installation. These Terms, and not the terms or policies of Apple, Google or any app-store operator, govern your use of the directly distributed MakZens clients.

You agree to indemnify, defend and hold harmless JXMSN LLC and its officers, employees and agents from and against any claims, liabilities, damages, losses and reasonable expenses, including legal fees, arising out of or connected with your breach of these Terms, your misuse of any MakZens feature, the content of messages, files, voice notes or locations you transmit or share, or your infringement of the rights of any third party. This indemnity extends to claims arising from your participation in the referral programme, your use of the JokerX/NFT Premium unlock, and any content you submit that is transmitted to third-party translation providers for real-time translation. Your indemnification obligations survive the termination of your MakZens account and of this agreement.

If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable under the laws of the Emirate of Dubai, the United Arab Emirates or any other applicable jurisdiction, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable while preserving the parties' original commercial intention. If such modification is not possible, the relevant provision or part-provision shall be deemed severed, and the deletion shall not affect the validity and enforceability of the remainder of these Terms. Any invalidity in one jurisdiction shall not affect the validity or enforceability of the provision in any other jurisdiction.

No failure or delay by JXMSN LLC in exercising any right, power or remedy under these Terms shall operate as a waiver of that or any other right, power or remedy, nor shall any single or partial exercise of any right, power or remedy preclude any further exercise of it or the exercise of any other. Any waiver by JXMSN LLC of a breach of these Terms shall be effective only if made in writing and shall not constitute a waiver of any subsequent breach. In particular, JXMSN LLC's tolerance of any non-compliant use of the translation, referral or Premium features shall not be construed as consent to continued or future non-compliance.

You may not assign, transfer, charge, sub-contract or otherwise deal in any of your rights or obligations under these Terms without the prior written consent of JXMSN LLC. JXMSN LLC may assign, transfer or novate any or all of its rights and obligations under these Terms to any affiliate or to any successor in connection with a merger, acquisition, corporate reorganisation or sale of assets, and may sub-contract the performance of its obligations, including translation, payment processing, NFT verification and referral settlement, to third-party processors. Such assignment or sub-contracting shall not diminish your rights under this agreement or the MakZens Privacy Policy.

Nothing in these Terms is intended to, or shall be deemed to, establish any partnership, joint venture, agency, employment or fiduciary relationship between you and JXMSN LLC beyond the provision of the MakZens service. In particular, your participation in the MakZens referral programme, under which partners share a personal link and commissions are calculated and settled by the third-party JokerX system, does not make you an employee, agent or legal representative of JXMSN LLC, and you have no authority to bind or make representations on its behalf. You are solely responsible for any tax, disclosure or regulatory obligations arising from referral commissions you receive.

A person who is not a party to these Terms shall have no right to enforce any of their provisions, and no third-party processor, including any AI translation provider, NowPayments or the operator of the JokerX system, acquires any right against JXMSN LLC by virtue of this agreement. Save as expressly stated, nothing in these Terms confers any benefit on any third party. The parties may vary or rescind these Terms without the consent of any third party.

Any notice required or permitted to be given under these Terms shall be in writing and in the English language; notices to you may be given by in-app message, by push notification (the payload of which carries only the sender identity and a generic placeholder rather than message content) or to the email address associated with your MakZens account, and notices to JXMSN LLC shall be sent to [insert legal contact email] or, for data-protection matters, to privacy@makzens.app. Notices shall be deemed received at the time of delivery to the account or, in the case of email, upon successful transmission absent a bounce notification. The English-language version of these Terms shall prevail over any translation provided for convenience, notwithstanding that MakZens itself offers real-time translation of user messages.
